mon Ella Dewald by making publica
tion of this citation once in each week
for four successive weeks previous to
the return day hereof, in some news
paper published in your County, to
appear at the next regular term of
the 41st District Coiert of El Paso
County, to be holden at the Court
House thereof, in the City of El Paso,
Texas, on the first Monday in Novem
ber, 1910. the same being the 7th day
bf November, 1910, then and there to
answer a petition filed in said Court
on the 10th day of October. 1910. in a
suit numbered on the Docket of said
Court No. 8345, wherein John F. B.
Dewald is plaintiff, and Ella Dewald
Is defendant, and said petition alleging
That on or about the 4th day of
June. 1906, the defendant voluntarily
abandoned this plaintiff and his homo
and refused and has continued to re
fuse to reside with him as his wife.
That this plaintiff has at all times
been ready and willing to live and co
habit with defendant as his wife and
that the failure of plaintiff and de
fendant to live together as man and
-wife was brought about and occasioned
eolelv by said defendant.
That they have no community prop
erty as the'issuance of said marriage.
Herein. Fail Not, but have you before
said Court, at Its aforesaid next regu
lar term, this writ, with your return
thereon, showing how you have exe

NOTICE TO BIDDERS.
Sealed proposals for furnishing all
labor and material for the building
complete of a STORM SEWER on the
north side of Main street, from the
west line of Oregon street to the west
line of Santa Fe street in El Paso,
Texas, and all excavation and filling
.necessary to build the same, will be
received by the City Clerk of said city,
at his office in the City Hall in said
city, until 11 a. m., standard time,
November 3rd, 1910, in accordance with
the plans and specifications on file in
the office of the City Engineer of said
citv.
The price of a complete set of plana
and specifications, will be $10, which
shall be paid to the City Engineer on
the receipt of same; which price will
be returned on the return of said plans
ard specifications to bonafide bidders.
These proposals shall specify the
price per cubic yard for concrete,
which shall include all forms neces
sary for erection and all timber necs
sary to protect banks, roadways, build
ings, etc.
The proposal shall specify separate
prices per pound for steel, which shall
include the placing, and separate
prices per cubic yard for all earth re
moved. Proposals shall be made on the
blank forms to be obtained from the
C ty Engineer and shall be sealed and
filed with the City Clerk before the
hour stated, when they will be opened
by said City Clerk and publicly read.
All proposals will be considered in
formal and rejected which contain bids
not asked for or which do not contain
prices in words and figures, or which
otherwise are not in conformity with
this notice. j

by a certified check upon a National
bank, drawn to the Treasurer of the
City of El Paso, in the sum of five
hundred dollars C$500.)
The bidder to whom the contract
may be awarded shay attend at the
office of the City Clerk with the sure
ties offered by him, within ten (10)
days (Sundays excepted) after the
date of the notification by the city of
the acceptance of his or their proposal,
and there sign a contract in triplicate
for the work.
In case of the failure so to do, he
or they will be considered as having
abandoned the same and the certified
check accompanying his proposal shall
be fcrefeited to the city.
The checks of all unsuccessful bid
ders will be returned upon demand and
also the check of the successful bidder
upon the execution of the contract and
the furnishing of the required bond.
A bond in the sum of five thousand
dollars ($5000), with sureties satisfac
tory to the City Council will be re
quired for the faithful performance of
the work.
All bids will be compared on the
basis of the Engineer's estimate of the
work to be done, as follows:

a broadening- tendency and a strength
ening of values. Good wools are re
ported scarce, while poorer grades are

stock. A liberal amount of fine staple
changed liands at 24 cents. On trans
actions in fine Delaine, fractional ad
vances have been obtained with 27
cents for unwashed. Pulled wools

Witnesses in Chinese Smug
gling Case, Give Plain
' Testimony.
When the hearing oi the ease of the
government against Mar Chew, -whom it
is trying 0 remove to Xew Mexico for
trial on the charge of conspiring to
smuggle Chinamen into the United States,
was called by United States commission
er George B. Oliver Tuesday morning,
George 21. Scott, who is under indict
ment in Xew Mexico, in connection with
Mar Chew and others, on the charge of
Chinese smuggling, was on the stand.
'He testified that Yee Yit had paid
money for the transportation of eight
Chinamen to Chicago, hut the witness
would not say that the money came from
Mar Chew. He said that Mar had said
that Yit was Ms agent. Scott, who was
at the time of the alleged conspiracy a
brakeman on the Southwestern, admitted
that he had been assured an immunity
bath for testifying against the others.
He said that he had never smuggled any
Chinamen into the United States and
that he only agreed to carry them to
Chicago, after they were put on his train.
During his testimony Scott gave an
original definition of a railroad brake
man as compared to a conductor. "A
brakeman does all of the work' he said,
,cand the conductor runs the train, does
the heavy thinking and draws the pay."
The defence objected to the govern
ment's questioning the witness about a
conversation with Lon Miller, a negro
train porter convicted at Las Cruces,
and the witness was excused while the
attorneys sought decisions.
Lon Miller told of carrying Chinamen
from White's Spur, where" thev were de
livered by a Mexican named Felippe, and

never received any money direct from
Mar Chew.

A voluntary petition in bankruptcy
was filed in federal court Mondav after
noon hy White, Sweatt Bros. fc"Co., of
Grand Falls, Ward county, Texas, admit
ting debts of $71,274.83 and assets of
$62,222.16. The petitioning members of
the firm are Edward Van Sweatt, Eu
gene Walker Sweatt and John Thomas
Sweatt, jr.
It is asserted in the petition that the
other member of the. firm, "VV. A. White
of El Paso, refuses to join in the peti
tion. A petition of voluntary l&ankruptcv
was also filed by John Thomas Sweatt,
sr. of Grand Falls, who tsfcifp ! Ti
is insolvent. The schedule shows debts
amounting to $82,079.12 and assets of
$90,615, of which he claims $17,490 is
exempt under the law. The firm of
White, Sweatt Bros. & Co. did a general
mercantile business.
TWO INJUNCTIONS.
In the 34th district court Tuesday Mrs.
Anna M. Calnan obtained an order pro
hibiting sberiff F. J. Hall from selling a
tract of Campbell street propertv. In
the 41st district court, Z. T. White and
others obtained a prohibitive order
against W. H. Austin and others from
building a fence on property in El Canu
tillo. SUIT FOR DAMAGES.
Suit for $4000 damages was filed in
the 41st district court by -G. Munoz
against the Western Union Telegraph
company. The petition recites that a
telegram sent last summer from Los An-
geles by Mrs. Munoz wa3 not delivered
to her lather, b. Madrid, who lives it
the 700 block on Campbell street.
SPRINGER SENTENCED.
Herman Springer, convicted on a
charge of forgery, was sentenced Tuesday
morning to serve a two vear term in
the state penitentiary. He had asked for
a new trial because C. H. Brown, one
of the jurors sitting in the case, com
mitted suicide a short time after the ver
dict. WOMEN BOUND OVER.
On charges of theft over $50, Mrs. A.
L. Yost and Mrs. Grace Soper were bound
over to the grand jury following a hear
ing Tuesday morning" in justice McCIin
tock's court. The complaining witness
is Mrs. O. H. Scott, 710 San Antonio
street, who alleges that she lost $S0 on
Friday evening last, when her house was
ransacked. The -women occupied rooms
at the house. Mrs. Yost gave bond and
Mrs. Soper expects to.
FORTY-TWO CARS OF CATTLE.
A shipment of 25 cars of cattle, im
ported bv John T. Cameron, were passed
through this port Monday evening, and
an additional shipment of 17 cars were
passed Tuesday morning.
