PRACTICES IN IKE LiD OFFICE The Government Institutes Means to Protect Entry men at Las Oruces. Las Cruces, N. M.. Jan. 14. The United States land office at Las Cruces, N. M, has just received a copy of the new 'rules of practice, -which -will gov ern all proceedings before'the local land offices, the general land office and the secretary of the interior, be ginning February 1, 1911. The new rules of practice make many very important changes in land office matters, the most important of which is in the matter of contests. Heretofore a contest against any en try could be made by any one, which has" caused a good deal of useless liii--gatlon before the department, owing to the fact that neighboring homesteaders disagreeing, often brought contests for spite, others brought contests with a view to selling the preference right to the land acquired by reason of the con test, and, in fact, it has been the prac tice to initiate contests against home stead and other entrymen on very slight pretexts: Who May Bring: Comtests. However, beginning February 1, 1911, contests can only be brought by per sons seeking to acquire title to, or claiming an interest in, the land in volved. For this reason, after Febru ary 1, any one initiating a contest against any entryman will have to show, first, that he is seeking to ac quire title to the land in-contest; sec ond, a statement of the law under Which he intends to acquire title if he is given a preference right; third, a sworn statement showing that he is a qualified entryman; fourth, that the contest lie is initiating is not "collusive or speculative, but will be dilligently pursued in good faith. liust Be Witnessed. All of the above statements, together with the usual statement of charges and allegations, must be cororborated by one witness under oath. Upon a contest being allowed by the officials of the local land office, a notice of the charges made will be'sent to the entryman. Unless he appears within 30 days after service of this notice upon him and answers the charges, or denies the same, the alle gations made will be taken as confess ed and decision will be rendered by the register and receiver without fur ther proceedings. The rule as to serving a notice of contest either nersonallv nr hv miMiwi- I tlon has not been changed. Dismissing Contests. Another important change provides that unless a notice of contest is per sonally served, and proof of this ser vice returned to the local land office within 30 days after issuance of such notice, or If where service by publica tion is ordered, publication is not com menced within 10 days after the order is made, and the proof of publication filed with the local office within 10 days after the lasj, publication, then the contest shall be dismissed. Ground for Xeiv Trial. k Decisions of registers and receivers will only be vacated and new trial granted upon the ground of newly discovered evidence, and then only up on a showing that substantial rights of one or the other have been injuri ously affected. No person who has failed to answer a contest affidavit, or having an swered, has failed to appear at the hearing, shall be allowed an appeal from the decision of the register and receiver. In all events the decision of the reg ister, and receiver will be final, and will not be disturbed except in cases of fraud or gross irregularity, or of disagreement in the decision between the register and receiver, unless an appeal is taken within the time, al lowed. In proceedings before the secretary of the interior motions for review and rereview are entirely abolished. The bag gage room at the Santa Fe station here was broken Into and a trunk and clothes hamper stolen." The articles were carried behind the water tank and there forced open, but so far there has been no means of finding out what was taken. The theft was dicovered yesterday. Deputy sheriff Moreno fol lowed the tracks as far aS' Mesilla Park and there lost them, but heard of three men who had passed south on the railroad track earlier in the morn ing, and followed them. He found the three men near Mesquife but they were not arrested. However, they stated that they had seen two men with bundles catch the early morning northbound freight train at Mesilla Park. The Bay View club of this city is endeavoring to have the cfty council turn over to its management the old baseball park on South Fourth street, so that it may be convertea-Into a city gark. Several years ago the owners of the McGee ad dition to Tucumcari. donated this plot of ground to the city on condition that it make a park of it, but since that time, the Tucumcari Athletic associ ation has held a lease on the place, using it for ball games and various other athletic events. Now, it is claim ed, the club has sufficient funds with which to improve the propertj7", and it is aimed to remove, the old building on "the lots and plant trees.
