Mrs. Darden was a pioneer Texan, having lived in Seguin before the war. She was first married to Joseph Evans, a pioneer merchant of San Antonio. Some years after his death she mar ried Col. Darden and made her home in Austin, w'here their acquaintance I became state-wide. SAYS SOUTHWEST IS TREATED UNFAIRLY Kansas Man Tells Commer cial Congress Rates Are Pronibitive. Salt Lake. Utah, Aug. 29. Prefacing his remarks with the explanation that he did not believe the railroads, as a whole, were collecting more for the transportation of freight than thev were entitled to. judge A. E. Helm c Wichita, Kansas, told the trans-Mississippi Commercial congress today that in his opinion the people of the south west were required to pay too much; nut tney were robbed of the natural advantages that should go to them bv reason of their proximity to the deep water ports of the Gulf of Mexico and were deprived of the use of the Gal veston gateway. "In Texas," he said, "the railway commission enforces reasonable rates to and from that port but -when ycu pass the Texas border it would be just as well for you If the port of Galveston were blotted out for it is absolutely- of no benefit" He quoted the rates from Galveston to Oklahoma and those from. New York to Oklahoma by rail to show that tne fonrer rate was prohibitive of compe tition with the latter. "This," he said, "is because the rail road companies own the steamship lines engaged In coastwise traffic be tween New York and Galveston and It is to their interest to maintain as nigh a level of rate as possible. What the steamships lose in business is more than made good by the rates they are able to charge on the long haul from New York by raiL" To remedy the condition judge Helm had ofered a resolution recommend ing an amendment to the interstate commerce law which would make it unlawful for any railroad company t own, operate, lease, control or have an interest in any -water carrier engaged in coastwise traffic. Two supplemen tary resolutions, one to "extend th jurisdiction over the rates and prac tices of the water carriers, and an other to let the- commerce commissio-. fix minimum as well as maximum rail road rates, accompanied the first pro posal. Minimum rates were made necessarv judge Helm contended, because the railroads were able to meet any en forced reduction from gulf ports to the northwest with similar reductions from the eastern states which left the rela tive status unchanged. At the conclusion of judge Helm's address a motion was carried to au thorize the president of the trans Mississippi congress to appoint a com mittee on transportation of seven mem bers to deal with resolutions and legis lation on the subject "See America First.' The "See America First" day of the trans-Mississippi commercial congress closed at Saltair with the adoption of a resolution presented by A. L. Som mers, of Tacoma. Wash., asking that the president of the United States Is sue a proclamation each year setting aside one day to be known as See-America-First day. The resolution asks also that preach ers and ministers of all creeds touch .on this topic at least once each year and that all public schools take up the subject insofar as it is possible for them. COLQUITT URGES FEDERAL BUREAU FOR RECLA3IATIOX Austin, Texas. Aug. 29. Governor Colquitt today addressed a communi cation to the National Irrigation con gress now in session at Salt Lake City, urging the congress to adopt resolu tions urging upon the federal govern ment not only to make liberal appro priations for the reclamation of and irrigation of the arid lands of the west ern section of Texas and other arid lands of the country, but also for the creation of a federal bureau designed for that purpose. The re call of juages was formally denounced by the American Bar association as a "fallacy," and Ws "tending to deprive the public of judges of ability and high character." William R Morris, of Minneapolis, one of the three negro lawyers who had been unseated by the executive committee, but which action was re- versed by the American Bar assoeia- tion, sent a telegram announcing h s resignation.
