said, but the road will make every
effort to provide adequate facilities
for its patrons.

Forgery Charge

trict attorney's office Indira XV. D.
Howe. In the 34th district coart. Sat
urday dismissed a state charge of
foreerr a pains t Carlos Helmus. This
action teas taken In connection with
habeas corpus oroceedinss Friday bj
attorneys zor iieimus, woo asset tea
that the constitutional rights of the
defendant to confer privately with
Helenas had been Invaded through ac
tion or oiiicers in placing1 a dicto
graph in his cell Helmus. who Is
charged In federal court with embez
zlement of funds of the First National
bank, is held under J 56.009 bonds.
Judge How, in order! nir the dis
missal said: "This matter now is out
of the Jurisdiction of this court, and
Mr. Helmus must apply to the federal
court In regard to his comolalnt.
Installed Vt Detective.
Three witnesses took the stand he-
fore the case was dismissed. IL R.
Erl brook, an operative of the Barns
Detective agency, the first witness,
testified he personally had installed
tne device last Sunday, but placed
only one dictograph on the cell win
dow, when Helmus was moved from
the north side of the Sail to the south
aide. He said he had made arrange
ments with R. K. Bryant. doutr
sheriff, for a room to place the listen
ing end of the device, but declared
his actions had no connection with
the United States government. In
cluding the marshal's office, ner any
connection with the state. He re
nlld to Dan Jackson, representing
Helmus. in the negative when Mr.
Jackson asked him If he had con
ferred with E. B. Elfers, assistant
United States district attorney. In re
gard to the instalatlon of the dic
tograph. He said be had conferred
with the department of Justice agents
in regard to the matter, and had been
told It was not possible to lnstal the
device.
Erlbrook declared he had never at
tempted to "listen In" and attempt to
gain Information on the conferences
of Helmus with his attorneys. When
the instalatlon was completed, he
said, he Intended to torn the device
over to stenographers.

been moved from the north side of
the Jail to the south side for the pur
pose of Installing the dictograph
more effectually.
E. R. Elfers. next on the stand. saM
sheriff Seth Orndorff had told hint In
the course of a conversation about tne
dictograph, and had told him that
he doubted whether it would work.

TEXAS COMMISSION ASKS
CHANGES "IN GRAIN RULES
Austin, Tex.. Mar 15. Recom
mendation was made today by the
Texas railroad commission to the in
terstate commerce commission that,
effective not later than Jnly l, l20.
the minimum weight on grain pro
duets, tn straight or mixed carloads,
be made 40.000 pounds, except that
when double loaded, the minimum to
be observed on the double load to be
69.000 pounds or SO.000 sounds seo-
arately on each shipment in the
double load car." The Texas commis
sion states that this recommendation
is made as a result of the hearing be
fore it April 34. and the hearing be
fore the interstate commission. May

LITTLE MOTOR KAR COMPANY
DIRECTORS ARE INDICTED
Dallas, Tex May 15. Three offi
cials of the Little Motor Kar company
were Indicted by the Dallas county
grand Jury yesterday on charges of
embezzlement and conspiracy to em
bezzle from the company
The men Indicted were W K. Lie
zey, George W. Strieker and R. I.
McCoy. Llvezey is In the countv 1e.il
and Strieker and McCoy out on bond-
seven indictments against each of
the three men charge embezzlement of
sums ranging from 65 to 545,000.

Last week. Clarence Stone, of Adel-

home la the quiet hills. He could
neither read nor write, and the lar
gest village visited in his 14 years
had numbered less than 1,00V people.

The bustling thousands at Camp
Sherman, military restraint and cus
toms weighed heavily on him and an
lmoellln? desire to see his wife and
baby boy led him to quit camp without
permission.
At home, his father, a tottering
wreck of the fivil war. told him he
was a deserter. Visions of the firing
squad flashed through his mind. Kiss
ing his wife and baby goodby he took
to a cave in the hills. He ventured
forth only at night. His only fare
was such scanty food that his wife
could get to him. herbs, wild berries
and such wild game as he could catch
Military authorities had abandoned
the search for imerine Three weeks
ago an attorney, friend of the famiiv
became interested and implored th-
that his was not a case of doaertlon
and there was no danger of a firing
quad. He left his hiding place last
Monday night and visited Stone's
home, where he agreed to give him
self up. ,
Early Thursday, he went again to
Stone's home. Ills wife brought his
uniform, which she had neatly pressed
for the occasion.
With Stone and an attorney. Ame
rlne went to Camp Sherman and sur
rendered himself to the adjutant. He
made no comment except that he was

liquor was found to the ear. and Day
is charged with conspiracy to ship
liquor from Van Horn to Fort Worth.
Day recently left here for Fort
Worth In a motor car, according to

his ear broke down at Van Hern, and
he hired Manuel Dianda to drive to

the Information and new accounts

just returned from a 10 days visit to
his former home at Las Vegas. N. M.
During his absence Mr. Raynolds's
brother, Hallett Reynolds, took his
place.
Las Vegas ts growing rapidly and
making great progress, Mr. Raynolds
saya. That part of New Mexico
around Las Vegas U becoming a
great fishing country, the banker
says. When the season opens, June 1,
there will be fishing in the Rio
Puebla and the Mamltas that will
satisfy the most enthusiastic angler,
he avers.
