Section s.—Said bonds shall be Issued against said district amount ing in the aggregate sum equal to tho amount of said assessment re maining unpaid at the time of their Issuance, but not In excess of the cost and expense of said Improve ment, which bonds shall bear Inter est at the rate of seven (7) per cent per annum from the date of their Issuance, and shall be num bered consecutively find be In de nominations of not less than $100 each, except the first numbered bond which may be more or less, if necessary; said bonds shall be Issued and dated not less than thir ty days after the expiration of the time that said assessment shall be paid without Interest, penalty or cost, and fixed by the notice of the Town Treasurer that said assess ment roll Is in his hands for collec tion; all as Is provided by Chapter 98 of the Laws of the State of Washington for 1911, and ordinan ces of said Town. Section 6. —Said bonds shall be accepted by tho contractor at par In full payment of said work, and said contractor shall have no claim whatsoever on account thereof against the Town of Steilacoom ex cept upon said bonds, special as sessments made, and the fund herein created for the payment of said work. Section 7.—That the contract for said Improvement shall be award ed to the lowest responsible bid der; and the Town Clerk is hereby directed to publish in the official paper of the Town of Stellaeoom once a week for two consecutive weeks, a notice inviting bids for the construction of said Improve ment according to said plans and specifications and this ordinance, which notice shall state where said plans and specifications may be ex amined by prospective bidders; that said bids will be received by tho Town Council until 7:30 P. M. on the 6th of May, 1912, at which time the Council shall proceed to open and consider all bids received, re serving the right to reject any or all of them. Section B.—That the successful bidder to whom said contract shall be awarded shall enter Into a written agreement with the said Town for the construction of said Improvement within ten days after the awarding of said contract; and that at the time of the entering In to said contract, said contractor shall execute a proper bond with corporate surety, subject to the approval of said Council, In the sum equal to the contract price running to said Town, conditioned for the faithful performance of said contract, and that said con tractor shall hold said Town harm less from' any and all damages or losses arising from any cause whatsoever to persons or property in connection with the construction of said improvement, all as Is pro vided by the statutes of the State of Washington, and ordinances of said Town, ftnd said contract shall not be deemed to be In full force until said bond shall have been ex ecuted, delivered and approved. Section 9.—That said contractor shall pay Into the treasury of said Town the amounts required to be paid to the State of Washington, by Chapter sevenly-four (74) of the Laws of the State of Washington for 1911 (Workman's Compensation Act) before any payment Is made to him by said Town.
