BARBERS' UNION
MAKES BENSON
SHOP "UNFAIR"
At the spec iel session of the barbers'
Union last night in the t'entral Labor
hall it was voted to declare the Benson
barber shop unfair and to call out the
employes on the ground that he k:'eps
open after the agreed hours. All the
employes who refuse to leave will be
put out of the union nnd a fine levied
against them. A heavy fine will also
be plated against the llenson shop, sn
that should the proprietor again want
to affiliate himself with the union
employes he will be compelled to first
pay into the treasury of the union a
snug sum of money.
When s-ked what hia intentions were
this morning. Mr. Benson became very
indignant and referred to the matter
and the statements made by the bar
bers as lies out of whole cloth. He

quite seriously i ut another colored
man named Joe Ha gen at the Hotel
Spokane, have proved futile. The
cutting was the result of an alter
cation over orders. Both men are
waiters nt the hotel.
While the battle of the people witli
the anthracite shade was in progress
the hotel kitchen was in an uproar.
Colored waiters of every shade un
der the sun were dodging the two
fighters as they fought around the
"dishup" tables In frantic efforts to
reach one another. Keating, it is al
leged, was the aggressor and drove
Hagi n. an older man, Hbout, pursuing
him with the fury of an enraged
maniac.
The only thing that saved ITngcn's
life was the fact that the knife used
by Keating was a small pocket
weapon. As it was, Hagen's face la
slashed by numerous cuts. There are
Beven wounds on his face and body.
When the men were finally separ
ated the friends of Keating spirited
him away and today he has been kept

The barbers claim the council will

Members of the Trades Council say

ing to adjust the differences between
Benson and the barbers' union, but
without success. They now assert that
the council will without doubt endorse
the action of the union, as the latter
has been perfectly regular in all its
act ions.
JUMPED TO
HER DEATH
KANSAS CITY, Feb. 11.—Mrs. Jea
sic Averill was killed and five others
seriously injured this morning in the
fire of tbe Holmes Hats, at Fifteenth
and Harrison streets. Mrs. Averill
jumped from the third story to her
death. The damage is estimated at
$.so,ooo.

It is not often that a jury instead of
handing in a verdict hands out a law
suit, yet J. T. Argyle, foreman of the
jury which sat on the case of Hobbs
and Rise versus Campbell, certainly
gave the defendants in the case a
chance to contest the verdict, for, in
tilling out the verdict blank. one
amount appears one place and another
another place.
'Hie jury brought in its verdict in
the superior court yesterday. It didn't
lake the attorneys in the case long to
file a motion for a new trial on the
grounds that the verdict was unintelli
gible, nnd that the proceeding! of the
jury were/Irregular. The motion was
presented at the county clerk's desk

the assessment district established
for the payment of improving Elev
enth avenue, in the city of Spokane,
from the center line of Monroe street
to the center line of Adams street, by
sidewalking the same, came duly and
regularly before the city council on
the 2d day of June, 1903, for approval
and confirmation, and no objection be
ing made thereto, the same was duly
confirmed and approved; therefore:
The City of Spokane does ordain
as follows:
Section 1, That the lots and par
cels of land descrlhed In tbe assess
ment district and on said assessment
roll for the said improvement, to the
extent of the assessments levied
against them, and each of them, be
and they and each of them are here
by assessed therefor, as in said as
sessment roll stated.
Sec. 2. That the bonds described

nnd delinquent on the 15th day of
March. 1904, and one on the same
day of each year thereafter, together
with interest on the same and on un
