One more man was indicted by the
grand Jury yestjrday afternoon and
one man has been sentenced to serve
a term in the penitentiary. This makes
the tenth man to be indicted by thj
present grand jury which is still In
session and the sixth m.n to be 'pre
sented with a ticket for the state o.-is-cu.
One other has been fined, an
other is awaiting sentence af'er hav
ing pleaded guiity, while the
two indicted men are awaiting trial.
Yesterday's victim was Albert
Stacey, who was caugh: recently

cial association gymnasium this eve

third game to be played by the local
academy ball tossers this year but It
will be the first time that their
friends have had an opportunity to
see them in action as the other games
by the Milton Progressive club for the
best phrase, of three or four words,
which would advertise Milton in out
side districts by being placed on en
velopes and stationery to be sent out
of Milton by business men and others.

William Quinn, arrested yesterday
on the charee of stealing a load of

Two of the most important games
of tho year for the Pendleton high
school besket ball teams will be Play
ed in Walla Walla tonight. The con
tests will be with the girls' and boys'
teams of the Walla Walla high. These
games are made annual events and
the winning of them is considered of
more Importance than any other con
tests of the year.
Last year the Walla Walla high was
the victor, but this year the locals
hope to return with a double victory to
their credit.
The lineup for Pendleton will be
Ruth Gibson and Lucille Rader at
guard; Gertrude Jordan and Daisy
McPJiearson at center, and Nona
Johnson and Eunice Vogel at forward
will represent the girls. The boys'
team will be McDill, center; Cooley
and Rader, forwards; Chapman and
hturdivant, guards Hazel Rader for
the girls and Storle and Kimball for
the boys will go along as substitutes

will accompany the teams as coach

of the bill of $300 Incurred by the dis
trict attorney In employing a detec
tive to securo the evidence by which
the grand Jury was enabled to return
a wholesale lot of Indictments and by
which the county was made the richer
by some $7000. an Injunction suit was
filed In the circuit court, late yester
day afternoon. A temporary restrain-
ing order was Immediately Issued by
Judge Rean, restraining the clerk and
treasurer from paying the bill.
lne suit was filed by Carter &
Smythe for C. C. Cunningham, the ex
sheep king of Oregon, and W. F.
Michael, a wheat grower. The com
plaint charges that the county court
In authorizing the payment of the
bll lacted without authority and with
out jurisdiction. It Is also alleged
that the county la exceeding the $5000
voluntary Indebtedness allowed by
law.
The Indebtedness at present is about
$50,000 and It urged that the detec
tive's bill Is one which the county
court may pay at its discretion and
therefore comes under the head of
voluntary Indebtedness.
This bill Is the one for which Com
mlssloner Walker refused to sign the
order of payment and to which Com
missioner Lee affixed hl.s signature
only after a long delay.
When seen this morning District
Attorney Phelps said he was busy
with the grand Jury Just now and
could not say when the case would
be brought up for argument. In
stating that the beginning of the end
of the case Is yet far off. It Is under
stood that the district attorney has
a trick or two up his sleeve himself.
The filing of the suit has been the
subject of much comment on the
street and at the court house. It Is
J"oked upon generally as an attempt
to tie the hands of the district attor
ney in his attempt to enforce the law,
and a step toward an attempt at mak
ing a farce out of prohibition In the
county, rather than an honest effort
to save money for the taxpayers.
