Little Rock, July 18—The mu tual liability of a railroad and a person crossing its tracks, with reference to the common rule to “stop, look, listen,” are discuss ed by the Arkansas Supreme Supreme Court in a Sebastian county case in the following par agraph : “The circumstances are such that appellant could not see the ] approaching train, therefore as | he approached the track he was ' under the greater duty to listen; I and as he had the right to cross , the track, and in doing so he was called upon to exercise only or dinary care, in looking and lis tening for the approaching train. Here the appellant listened but did not hear the approaching train because it neither blew' a whistle nor rang a bell, and he did not see the train because of the obstruction of the building and telephone pole. Of course, as he approached nearer the track, the angle of his vision widened but we cannot say as a matter of law that he should have approached nearer the track than he did before stop ping He was himself within 25 feet of the track and his team was, of course, nearer by its length to the track than he was. As he drove upon the track he was in duty bound to look in both directions; but this could be done only by looking in one direction and then in > another, and we cannot say as a matter of law that the jury might not have found that appellant de cided in the emergency, when he discovered the approaching train that the safest thing to do was to drive across.” Sabbath Movies Cause Friction United Press Service Niles, Ohio, July 18.—Do mov ing picture theaters desecrate the Sabbath?
