Murphy Cites Cases Giving His Version of a Much Disputed Point in Controversy. The following opinion has been rendered by Col. Geo. W. Murphy in reply to an Inquiry as to whether Albert Howard could hold the office uf constable should he be elected at the special e'eetion. Col. Murphy's opinion is as follows: Dear Sir: In answer to your re quest tor an opinion as to whether ex-Constable Howard, now a candi date for re-election, will be disqual ified by the recent judgment of tha, Circuit Court removing him from of fice In case of his election, l beg to give It as my view that he will not. In fixing fine and removal from of fice as the penalties for such of fensqs, the law excludes the idea of future disqualification. If it had been the purpose of the law-makers to add the further penalty of dis qualifies tfmi to hold office, they would have so expressed themselves, is is evidenced by the fact that they have dune so in prescribing punishment for offenses of such gravity us merit such disqualifica tion. In support of this view. ! might refer you to the different sections nf the digest of our statutes on the subject of misfeasance and malfeas ance in office, some providing fines ind removal from office, only for certain classes of these offenses ami others providing for other classes of them like penalties and also the fur liter penalty of disqualification to hold office. Forney Hutchinson on the State Hoard of Kdueation, Dr. Chas^ •hike on the State Medical Board, and Alderman Henry Weimar on the State Board of Pharmacy are three recent appointments from the hand of Gov, Donaghey in this city that have called for congratulations. The appontment of Dr. Dake had been made a few jays ago, and the appontment of Rev. Hutchinson was announced Wednesday. Yesterday Mr. Weimar received notice that he had been appointed to represent tnts city on the Stale board Of pharmacy. Mr. E. F. Klein has been on the state board of pharmacy for several years and has given much attention to the work, and the selection of Mr. Y\ oinsur is an nasurance that fully »s much public service will be rend ered by the Hof Springs representa tive.
