Court Silas El. Speckmann If paying crops can be obtain ed from land without irrigation, the land is not desert in charac ter and is thus not subject to desert land entry. On the other hand, if it is claimed that land will not thus produce without ir rigation and is upon that claim fentered under the Desert Land Law; then irrigation must be performed in order to acquire title. Under the liberal provisions of the Act of May 29th, 1908, (35 gtat., 407), actual residence means presence on the land ae a home, unless absence is con strained by such force as de prives the claimant of voluntary 'control Of himself. “Actual” in this statute must be construed hs "real,” as opposed to con structive or notional.
