The Nelms-Las3iter murder case came up for heatinz ia our Circuit Court last Friday forenoon. It required some time to make up the jury as several panels had to be made, he jury was complete by 2 o'clock in the afternoon, whe n the hearing of testimony began More than thirty witnesses were ex amined. The testimony -was con cluded late Saturday afternoon. 2he evidence showed that Wm. Nelms, the defendant, slew "Bud"' Lassiterat a picnic at Sulphur Springs near Pocahontas; on the 21st day of August; 1886, Tha weapon used was a large pocket knife, and the mortal stab was mt? the heart. The State was repre sented by. the Attorney General and by IIon.Jessee Norment- The de fense by Hon. Wm Inee, of Corinth Miss,, and Wood & McNeal, ot Bol ivar, he theory of the prosecu tion was when the altercatkn between Nelms and Lassitcr began that they both struck eaeh other abost th same time; and that Nelms struck with his knile, and inflicted the mortal wound which was a cut in the left breast about 4 ncLe i long and 5 inches deep. Then Nelms, seeing what he had done, turned to go away, and that Lassiter seized him by the collar, and pursued him 36 feet striking him over the head with his fist, and that at the end of the 36 feet Las siter sank down from loss of blood an 1 died in a few minutes, and thatNelm? fled.- The theory of the State was that at the very threshold of th difficulty, the amnsd lie was passed between them, and that Ladder struck Nelms in the lace and that Nelms turned to go away, and that Lassi ter seized him hy tha back of the neck and forced him along, all the time pounding him over the head with his fist, and that when he had pursued him beatinsr him. for 36 feet that Nelms had succeeded ia opening his knife, and that he partially turned upon his adversary, struck back, and inflicted the fatal wound. The weight of testim -ny; and the physical acts seemed to favor the theery of . The Slate, yet there; was strong testimony for theory of the defense. The charge was given the jury Monday evening, and after deliber ating about 24 hours returnee a verdict of guilty of assault and battery and fined $150 and cost.
