AN ACT to repeal and rc-enact with amendments Sections 278 to 286, both inclusive, of Article 17 of the Code of Public Local Lawj, title “Prince George’s County,” as the same were enacted by Chapter 90 of the Acts of Assembly of 1910, providing a system of Free Public Roads and Bridges in Prince George’s County, Maryland, defining the duties of the Board of County Commissioners of said County ia relation thereto, including the levy and expenditure of a Road Fund creat ing a Board of Road Directors defining their duties orovidiug for the payment of funds and surrender of road equip ment, stock and machinery by the Board of Road Directors created by said Chapter 90 or the Acts of 1910, and providing for the redemption and cancellation of the bonds authorized and issued under the provisions of said Chapter 90 of the Acts of 191 q. Section I. Be it enacted by the General Assembly of Maryland, That Sections 278 to 288, both inclusive, of Article 17 of the Code of Public Local Laws, title "Prince George’s County.” as the same were enacted by Chanter 90 90 of the Acts of Assembly of 1910, be and the same are hereby repealed and re-enacted, so as to read as fallows; Sec 278 There shall b? a system of free public roads and bridges in Prince George’s County, and all matters affect ing the roads and bridges in said Coun ty shall be under the control of the Board of County Commissioners of said County, except in incorporated towns and except in so far as control is con ferred upon the Road Directors creat ed by this Act. t Sec. 379. There shall be in Prince George’s County six (6) Road Directors, who shall together constitute the Board of Road Directors of Prince George’s County Said Board shall meet at least once a mouth in the Town of Upper Marlboro, in some ron in the Court house set apart for their use by the Board of County . Commissioners on some day to be fixed by them, which day shall be one of rhe regular meet ing days of the Board of County Com missioners. Each of said Road Directors shall have sole authority over the actual working of the mads and the repair of bridges in one of the Road Districts in Prince George’s County, as hereinafter set out. He shall devote his whole time to his duties, shall give his person al supervision daily during working hours to the management and direction of the working of his Road District, shall take charge of the mad equipment assigned to his Road District, shall era pi iy and discharge lab >rers, employing the same by the month whenever nossi ble and shad be responsible for al machinery and equipment in liis poss ession. He shall keep in a book, to bs provided for that purpose by the Board of County Commissioners, a fu l.com plete, accurate and easily understood account of all moimy expended by him and all charges incurred in each of the several Election Districts of bis Road District, which book shall be opened to the inspectio : of any taxpayer at any reasonable time. In case any road machinery, rollers, carts, w tgous, mules, plows, scrapers, or other things necess ary to properly work the roads and build bridges and culverts arc needed in any of the Road Districts herein after created, or in case any of the equipment in use in said Districts can profitably be disposed of, the Road Director in charge of such District snail have power to purchase orsUl the same and apportion the cost thereof or the receipts therefrom to the several Elec tion Districts in which the same is to be used or has been used. The Board of Road Directors shall appoint a Clerk and Secretary to said Board, who shall attend their meetings, act as Secretary therein, take charg of and file any papers in connection there with and who shall keep the account of the Road Fund of Prince George’s County in accordance with a system of accounting to be adopted by the Board of County Commissioners of Prince Geo rge County, which system of accounting shall show in detail the disposition of said Road Fund, the amount expended generally and the amount expended in each Road District and in each Election District of each Riad District. Slid prepare annually each year a Clerk shall statement showing the receipt and ex pendilure of said Road Fund, which statement shall be published in at least two newspapers in said County in the month of December in each and every year by the Board of County Commis sioners. Sec. 280. The Board of County Commissioners shall have the charge and custody of the Road Fund of Prince George’s County as hereinafter provid ed for and after apportioning the same and paying the fixed charges including the sum of .SIOO.OO, to their Attorney for legal advice in connection there with and such other sums as ma ? be proper to be paid out of the entire amount of said fond as provide i for by this Act, they ;-ha!l pay out the amounts apportioned to the several Road Dis tricts and Election Districts thereof upon warrants from the respective Road Directors in charge thereof for labor, materials, provender, equipment, etc, used or to be used in such Districts under the provisions of this Act: And each of said warrants shall b.; in a form prescribed by the Board of County Commissioners, shall show' in detail the purpose for which ihe payment is to be made and the Election District or Dis tricts and the Road District to which such payment is to be charged. It is the intention of this Act that the Board of County Commissi mers shall have m their office, open to the reasonable inspection of the public at any time, a full and complete record of the amount of the Road Fund and the proper disbursal thereof. Sec 281. Prince George’s County for the purpose of this Act is divided into six (6) Road Districts. Road Dis trict No. 1 shall be Composed of Elec tion Districts No. 10 (Laurel), No 1 (Vansvillc), No. 17 (Cnillum), and No. 16 (Hyattsville). Road District No 2 shall be composed of Election Districts No. 2 (Bladensburg), No. 19 (Riverdale, No. 13 (Kent), No. 11 (Bowie). Road District No. 3 shall be composed of Election Districts No. 18 (Seat Pleasant), No. 12 (Oxen Hill), No. 6 (Spaulding) and that part of No. 15 (Melwood) north of the State road leading from Marlboro to Washington. Road Dis trict No. 4 shall be composed of Elec tion Districts No. 7 (Queen Anne), No. 3 (Mailboro) and that part of No- 15 I Melwood) south of the State road lead ing from Marlboro to Washington. Road District No 5 shall be composed ot Election Disti in>-~ 5 (Piscata way), No. 9 (Surra,., we) and that part of No. 11 (Brandywine) west of the railroad known as the Popes Creek branch of the Pennsylvania Railroad. ! Road District No 6 shall he composed of Election D stricts No 4(Nottinguam), ; No 8 (Aquasco) and that part of No ll (Brandywine) east of the Popes Creek branch of the Pennsylvania Raijroad. The present road equipment of the County shall be divided as equally as possible by the Board of Road Directors into six parts, each of which parts shall be exclusively used in one of the above named Road Districts, unless otherwise transferred for emergency work. Sec. 282. The following persons are hereby named as Road Directors to have charge of the working of the roads ' in the several Road Districts of Prince ' George’s County until the first Monday in March, 1918. First Road District, John D. Smith. Second Road District, William W. Brady- Third Road District, Benjamin E Randall. Fourth Road District, Herbert M. Hardv- F’fth Road District, Richard B, Edel en- Sixth Road District, William S. Chichester. Each of said Road Directors herein named and those hereafter to be elected, under the provisions of this Act, shall be removable by the Board of County Commissioners for incompetency, neg lect of duty, misconduct or malfea sance in office, after charges preferred ' due notice and public hearing. If any Road Director shall be dissatisfied with i the action of the Board of County Commissioners In removing him. he may appeal to the Circuit Court for Prince George’s County within ten (10) days from the date of his said removal, such appeal shall be in the nature of a pro ceeding byway of certiorari and shall be determined bv said Court as speedily as possible after hearing the same. At the general election held on the first Tuesday after the first Monday in November, 1917, and every four (4) i years thereafter the legally qualified voters of Prince George’s County shall elect six (6) Road Directors for said 1 County to serve in the six (6) Road Districts created herein for a term of 1 four years from the first Monday in March next succeeding their election, , or until their successors are duly elect | ed and qualified. The Board of County Com , missioners shall have power to open I new roads, construct bridges and close > old roads, when they shall deem it ad ; visable, following the provisions of • the Code of Public General Laws relat • ing thereto. The exoense thereof shall ; be charged to the Election District in i which said roads or bridges may be located, except as may be herein o.her wise provided and the work on such r iads shall be done by the Road Direc tor for said District. The Board of County Commissioners shall have the right to advertise for bids for the con : struction of bridges and culverts, and to award such work, under contract, to the lowest responsible bidder; where the cost of the same excesds $200.00, and m such cases the costs thereof shall be charged to the general fund and not to the respective Election District. They shall have the right to purchase or lease gravel banks or stone quarries or otherwise acquire desirable materials lor road construction and repair and shall have the right to condemn land for such purposes or for the purpose of widening, straightening or opening roads as land is now or may hereafter be coad tuned by law. The title to all property, real, personal, or mixed in any way used in connection with the road system of Prince George’s County s hereby vested in the Board of County Commissioners of Prince George’s County and it shall require no couvey ince or other action by any other agents of the County now in existence, to vest such title in the said Board of County Commissisuers. All proceed ings at law or in equity now pending against any agents of said County on account of roads or bridges shall be defended by the said Board of County Commissioners and any judgment in any such proceeding shall have the same operation and effect as if it were •i judgment against said Board of County Commissioners. All liabilities now existing in connection with the roads and bridges of Prince George’s County shall be assumed by them from the date of the passage of this Act and all future proceedings at law or in equity relating to the roads and bridges and the Road Fund of Prince George’s County shall hi brought against the said Board of County Commissioners for such purpose. Sec 284 The County Commission ers of Prince George’s County shad in their annual levy next succeeding the passage of this Act, and in every annual 1 -vy thereafter, levy upon the assessable properly basis of Prince George’s County not less than twenty cents, nor more than thirty cents per SIOO of such assessable basis for the use of the roads and bridges of said County. The County Treasurer of said County is hereby directed to report on the first of each month, beginning June first, of each year to the said County Commiss ioners the amount of County taxes collected by him for the preceding month and on the Tuesday next suc ceeding the date of such report, the said County Commissioners are hereby directed to draw their warrant on the County Treasurer for the use of the Road Fund for one-half of the amount so reported collected by the Treasurer each mouth until the whole amount of money levied for road and bridge uses in each year shall have been paid into the Road Fund. Should the levy for the year 1914 bs made before the passage of this Act, then the said County Commissioners, by their warrant on the Couotv Treasur er, shall draw all sums levied for the use of the roads aud fridges for said County by sucb levy no matter in whose name the said levy for such purpose may have been made. The Board of Liquor License Com missioners shall pay over to the Board of County Commissioners all moneys c dlecled from liquor licenses less their proper expenses and such rebates to in corporated towns as are provided by law and the said Board of Cmuiy i Commissioners shall apply the same as oth r road taxes collected under this Act are applied. The Board of County Commissioners are hereby directed to pay annually to the proper authorities of the incorporated towns in the County three-fourths of such part of said road aud bridge taxes as may be realized each year from the property within the . limits of the respective towns. Nothing herein contained shall be construed to prevent the County Commissioners of ; Piince George’s County from levying in ; addition to the road and bridge fund herein provided for, or from appropriat ing any sum or sums of money necessary ■ for the building of roads under any State Aid Road law now or hereinafter i iu force in this State, but on the con trary the said County Commissioners shall each year levy an amount ueces ary to take up such funds as they may think will be provided by the State authorities iu the succeeding year for State-aided roads in Prince Qearge’s County, and it shall be the duty of said County Commissioners to use the amount of said levy to carry on as far as possi ble a scheme of construction of State aided rSads in Prince George’s County, and all powers given the authorities of I Pi ince George’s County by the General j Laws of the State for the purpose of ! building such roads are hereby espe - I ially confirmed and vested in the Board of County Commissioners of Prince George’s County The Board of Road Directors created by Chapter 90 of the Acts of 1910, shall immediately upon the passage of this Act, pay over to the Board of County Commissioners all sums of money on deposit to the credit of said Board of Road Directors or in hands or control individually or otherwise, which are a part of the road and bridge funds re ceived by said Board of Road Directors from the County Commissioners or from the Board of Liquor License Commis sioners of Prince George’s County and said Board of Road Directors and Board of County Commissioners shall pay over to the Board of County Commissioners the amount on deposit to the joint credit of the said Board of Directors and the Board of County Commission ers, said fund being known as “Re demption aud Interest Account” and “Equipment Fund,” and said Board of Road Directors shall immediately, after the passage of this Act, surrender to the Board of Road Directors hereby created all personal property, equip ment, machinery, etc , which has been purchased by them or by the Read Engineer, mentioned in said Act of 1910, from time to time for the use of the public highways of said County. Sec, 285. All monies for the use of roads and bridges in Priuce George’s County from whatsoevr source the same I may be derived shall be deposited by . the Board of County Commissioners in , one or more banks of said County to the credit of said Board, specially as , County road funds. The total sum so received shall be used as follows; i The Board of County Commissioners . shall first deposit to the credit of a separate account, to be known as the , “Redemption and Interest Account” i in some bank located in Prince George’s v County a sum sufficient to meet the I payment of principal and interest on [ the bonds authorized under Sections I 287 and 288 of this Article in order i that the said bonds way be redeemed f and cancelled and the interest thereon , paid as prescribed therein. They shall then put aside, as a general fund, ' sufficient money to pay their own com r pensation for the duties imposed upon j them under this Act, which compensa tion shall be S2OO 00 per pear each’ to pay the salary of the Clerk and Secre tary to the Board of the Road Directors, which shall net be more than S3OO 00 , per year, to pay the salary of the six ' Road Directors which snail be $840,000 ’ per year each and to pay such other amounts as may be otherwise properly j payable by them out of such fund, under r the provisions of this Act, including t the rebate to incorporated towns. They shall then divide the remainder J of said money into six equa' parts each , of which parts shall be thereafter dc -1 voted exclusively to one of the six Road Districts and each of these parts shall be then apportioned by them to ‘ the Election Districts or parts of Dis -1 tricts in the Road District to which said part belongs, each Election Dis ‘ trict receiving as nearly as possible the ' proportion of said money which its road J mileage bears to the total road mileage 1 of its Road District and after such ap -1 portionraents are made no portion of ! said money shall be diverted from the ' Election District to which it has been 1 apportioned. In case there shall not ’ be sufficient money available in any year to start woik before the amount ! of the levy for such year is available. ’ the Board of County Commissioners ' are hereby authorized to use any sur ’ plus funds which they may have in hn<l during the months of March and April up to the sum of $10,009.00. In case such funds are useu ibeß iard of Coun ty Commissioners shall repay the same out of the first moneys received from the road levy of that year. Each Road Director shall he allowed to hire teams for emergency work in his Road Dis trict, but shall not use in this way an amount greater than S2OO 00. in any 1 one year in his entire road d str cL Sec. 286.
