Single copies Seen/* -All correspondence with this office should vtdressed to “Ta Kim in ana.” Friday, lecember 29th, W 22 THE TAX REVISION COMMISSION The first meeting of the Tax Revision Commission appointed by Governor Ritchie, under the provision^of Chapter 427 of the Acts of the General Assembly of 1922, was held on Thursday, December 14th. By the terms of the Act under which it was appointed the Com mission is requested to investi gate the systems of State, Coun ty and Municipal taxation in force in Maryland and to inquire into their practical operation and effect in the raising of adequate revenue. The Commission is in structed to inquire into the sys tems of taxation in force in oth er States and to ascertain their practical operation and effect; and is instructed to make a printed report to the Governor by December 1, 1923, for his use and for transmission by him to the General Assembly of 1924; which report is to contain a “draft of a general system of law providing for the imposition and collection of revenue, taxes and charges in the State of Maryland.” “With regard to its duties Mr. Francis K. Carey, Chairman, made the following statement: “Governor Ritchie has asked the Tax Revision Commission to perform a very difficult and res ponsible piece-of work; and al though all of us have been se lected by the Governor without —; any consultation with us, we have all thought it our duty to accept the appointments and have entered aggressively upon our investigations. ' “The Act requires all public officers of the State to supply us, on request, with all needed in formation; but our Commission feels that as it has a State-wide responsibility, which it must, of course, exercise in an absolutely impartial fashion, it must have the warmest . co-operation and _ support from all the officials of the State who have to do with the buestions of taxation, and we will seize upon the earliest opportunity to confer with these officials and invite their advice and suggestions. In the mean time, we will set in motion ma chinery for collecting, recording and digesting all possible infor mation which we can obtain from other States, many *of which, we understand, have re cently completed and reported upon investigations of this char acter, and in some of which modernized machinery for as sessing and collecting taxes has been in operation long enough to give reasonable evidence of its i practical operation. “Whether our Commission recommends to Governor Ritchie as the result of our study any radical changes in the present tax laws or not, I think the en tire Bar of the State and all of the taxing authorities will agree * with us in thinking that the ex isting laws can at least be put in a more orderly and intelligi ble form without the exercise of any high ability in Statute writ- • ing; and even if we find it un necessary or undesirable to rec ommend any radical changes in the taxing system of Maryland, I think we‘may be able to ren der a real service to the public 1 by recodifying the existing law ! so that it will be found under ’ one article and can be read and . understood by a man of ordinary j intelligence. * j “It is perhaps unnecessary to | ■say that the members of our \ Commission will take the great- * est pleasure in receiving and a carefully considering any sug- s gestions which anybody is good i enouph to make to us. Seciiou 1. Be it enacted by the General Assembly of Marlyand, That section 116A of Article 17 of the Code of Public. Local Laws of Maryland, title "Prince George’s County,’’ sub title ‘‘County Treasurer”, as the same was enacted by Chapter 184 of the Acts of 1912 of the General of Maryland, be and it is heroby re pealed and re-enacted with amendments so as to read a* follows: 115A- That if any person or persons, associatiorf or body corporate, shall be assessed upon the assessment books of said county with personal property only, and the amount of taxes levied thereon snail remain unpaid on the first day of January next succeeding the annual levy of taxes in saidc mnly, the said Treasurer shall within one mouth after said Ist day of January iu each and every year, or within one mouth after the uiscovery of any pro. petty belonging to such delinquent, subsequent to the first day of January iu eacU ami every year levy upon such portion as may be necessary to pay said taxes, interest, costs and fees as herein prov ded, of the persona] pro perty assessed to such delinquent tax payers, in the same manner as the sheriff of said county is now or may hereafter be authorized.by law to levy upon property upon execution on judgments issued out of the Circuit C met for said county, and shall ad veriise and sell personal property in the same manner as is now or may hereafter be required by law in the case of sales of personal property by the Sheriff of said county, and to deliver the properly so sold to the purchaser or purchasers th- reof, and for the pur pose of the levy of the sale herein | rc vided for, said shall have ailihepowers now had or lawfully ex ercised by the sheriff of said Court, ex ecuting executions on judgments of the Circuit (Jourt for said .county, and shall if it be necessary have the same power now or hereafter to be prescrib ed by law for the levy upon and the sale of shares of slock in any associa tion or corporation which the sheriff of said county may or shall possess iu executing executions or jadgmeulsof said Court; and said treasurer shall be entitled to receive out of trie proceeds of sales made under this section, the same fees and allowances as arc now or may here*Tter be allowed by law to the sheriff of said county on executions i-sued as aforesaid; this section, to be construed as an addition to, and net as a substitution for the powers o the treasurer to collect taxes assessed upon personal property by suit; and it is hereby expressly provided that said treasurer, if he deem such course ap visable, may proceed to collect any and “all taxes due upon any personal prop erty by suit, in the name of the County Comnrssiouers of Prince George’s County, before auyjustice of the peace in and for said county, provided, that at me time of instituting any su t f< r tlie collection of taxes upon personal properly before any just ce of tin peace, said treasurer shall file a cenfi caie, verified by his oath, slating that at least thirty days prior to the institu tion of said suit he seat a notice dir ected to the defendant taxpayer at the last known mailing address or ai his best known address advising him that his taxesou p< rsoual property were due and unpaid and the amount thereof, and unless said taxes were paid within thirty days, suit would be institlnted for their collection, and setting forth that, at least thirty days prior to the institution of said suit, he posted oi caused to be posted a s’-mPar notice to the above at the Court House door in Upper M ulboro. And out o f the pro ceeds of sale of personal property lUt treasurer shall pay all costs and ex pense iucidedt tc such sale, and the tax s in arrears and interest, and the surplus, if any,*h shall pay over to srch delinquent taxpaper. And any sale of personal property made under the provisions of this section shall Jr reported by the treasurer to the Cacuii Court bir Prince George’s County iu the same way that a sheriff’s sale is reported, w,ithin thirty days from said sale show ing to whom, and at what price, the ar ticles of personal property were respec tively sold, the amount of taxes and ot interest accrued and costs of said sale. CHAPTER 385 An Act to add a new section to Ar ticle'l7 of the C ids of Public Laws of Maryland (Outkett & Clagetts Edi tion), title “Prince George’s Count} - ), sub-t.itie "Elections.” said new sec tions to be known as Section 248A and to follow immediately 'after sec tion 248 of said Ar'ide, relating to the payment of the judges and clerks of election. Section 1. Be it enacted by the General Assembly of Maryland, That a new section be and it is hereby added .to Article 17 of the Code of Public Local Laws of Maryland (Duckett & Clagett’s Edition,) title "Prince George’s County,” subtitle "Elec tions,” said new section to be known as Section 248A, to follow fmmedi afler Section 248 of said Article and to read as follows: 248A. The judges and clerks of election shall be paid cash immediately upon the performance of their duties and upon the presentation of proper vouchers for the same. The County Commissioners are hereby authorized and directed to include in the annual levy a sufficient sum so that the srdii judges and clerks of election shall Be paid promptly and iu order to accom plish this, the said County Gomnrss ioners shall include in the levy for the year 1922 a sum sufficient to pay the salaries of said judges and clerks of election for two years, and thereafter annually a sum sufficient to pay the said salaries for that year.
