the receivership suit of the North
American Company attainst the Frisco.
The Cape Girardeau anil Northern
Railway Company, the petition states,
is a consolidation of the lines of the
Cape Girardeau anil Thebes Terminal
Railroad Company, Cape Girardeau
and Chester Railroad Company, Ches
ter, Perry ville and St. Genevieve
Railroad Company and Saline Valley

Frisco receivers have refused to take
over the property on the ground
that the purchase was nor authorized
by the stockholders or directors of
the toad.
It is asserted that the cost of
operating the load as part of the
t risen would be le-s than the cost
of operation as a separate system.
The court is asked to order the re
ceivers to take up the management
of the properties and carry out the
contract by which the road was
purchased.
