You are hereby commanded. That bv
making publication of this Citation in
some newspaper published In the County
of Tarrant four weeks previous to the re
turn day hereof, you summon John Zeb
McDanlel, whose residence Is unkonwn,
to be and appear before the District
Court, to be holden In nnd for the Coun
ty of Tarrnnt, at the Court House there
of. In the City of Fort Worth, on the first
Monday In July, A. D. 1919, the same be
ing the 7th day of said month, then and
there to answer the petition of Willie Et
ta McDanlel as plaintiff, filed In said
court, on the 26th day of May, A. D. 1919.
BKain John Zeb Daniel, na defendant, said
suit being numbered 49258, the nature of
which demand Is as follows, to-wlt: "
That on or about the 2sth day of De
cember, 190.1, the plaintiff was legally
married to the defendant in Milford, El
lis County, Texas.
That on or about September 1st, 1906,
defendant abandoned this plaintiff with
the Intention of permanently abandoning
her, and this without a cause, and they
have not lived together since said time,
but have lived apart for more than ten
years.
Plaintiff alleges that the conduct ol
defendant towards her aa above set
forth Is of such a nature aa to render
their further living together as husband
and wife Insupportable and unharable;
wherefore plaintiff praya the court that
defendant be cited to appear nnd answer
herein, and for Judgment dissolving said
marriage relations, for costs of suit, and
such other and further relief, special and
general, In law and In qulty to which she
mav he Justly entitled.
Herein FaU Not, hut have you then
and there before said Court, this Writ,
with your return thereon, showing how

day of March, 1919, and on divers dates
thereafter tip to and Including the 14th
day of April A. D. 1919. plaintiff at the
apeclal Instance and request of defend
ant sold and dellverd to him certain
goods, wares and merchandise at an
agreed price of 1911.70.
In consideration whereof defendant
then and there promised to pay plaintiff
said sum but wholly failed and refused
to pay the same with the exception of
$480.28, having a balunce due on auld ac
count of $433.42.
Yet though often requested defendant
has not paid said account or any part
thereof except as herein Btated, though

damage In the sum of 3450.00.
Wherefore, plaintiff prays for Citation
according to luw; that upon final hear

cause or provocation, defendant aban
doned plaintiff and their two children,
now minors, born to said parties durmn
their marriage; that this abandonment
on the part of defendant has been per
manent and he has never since said date
returned to plaintiff, or in any way pro
vided for her support, and all of wliicn
renders their further living together In
supportable. Vherefore, plaintiff praya for citation,
for Judgment for divorce, for the care,
custody and control of said children, for
costs of suit, and for general and special
relief.
