THE JEWISH. MONITOR Friday, August 6, 1920. RIGHT OF SABBATH OBSERVERS TO WORK ON SUNDAYS TO BE TESTED. The right of Jews and other Sev enth Day Observers to work on Sun days is to be tested according to a statement issued by Rev. Dr. Bernard Drachman, president of the Jewish Sabbath Alliance of America, having national offices at 110 Fifth Avenue, New York City. This decision is the result of the trials of three tailors, who are strict Orthodox Hebrews and who keep their establishments closed from Friday sundown to Saturday appearance of stars, and on all Jewish holidays. Their cases came before Magistrate Marsh of the 5th District Court, 170 East 121st Street, New York City, upon the complaint of one of the offi cers that they keep their tailor shop open on Sunday. The defendants are Messrs. Feldman, Link and Gorenstein of East 112th St. The Jewish Sabbath Alliance of America was represented by their counsellor, G. S. Drachman and their executive secretary, William Rosenberg. After bringing forth var ious witnesses it was proven that the defendants are strict Sabbath Observ ers and the work they did was of such nature (sewing or pressing by hand) as not to disturb their neighbors. Ac cording to Section 2144 of the Penal Code, which reads, "It is a sufficient defense to a prosecution for work or labor on the first day of the week that the defendant uniformly keeps anoth er day of the week as holy time, and does not labor on that day, and that the labor complained of was done in snch manner not to interrupt or disturb other persons in observing the first day of the week as holy time." these men should have been discharg ed. Magistrate Marsh did not listen to the plea of the Alliance representativ es and fined the defendants five dol lars each. The fine was paid with no tice of appeal to Special Sessions Court In spite of thefact that the Sunday Law has been a thorn in the side of all Seventh Day Sabbath Ob servers, both Jew and Gentile, a cam paign has never been waged before as will be now by the Jewish Sabbath Al liance of America, according to their executive Secretary, William Rosen berg, who has personally handled al most all the Seventh Day Observers' cases. The time has come when we are to be gathered once again into the land of our Fathers. You all know the legend that before the throne of God there is a cup into which fall the tears of the Jewish people and that when this cup is full we shall return to Pales tine.
