The meeting was called to order bv Ghairman Feist, after which the matter of the petition of A. J. The viewers in the matter being present, thev were ask ed to explain matters uertaining to assessments contained in their report. On motion a recess was taken un til 7:30 o'clock i). m. Abbott and others for a corntv diich. to-wit: Ditch No 23. was resumed, and interested narties heard relative to the matter. The following resolution was adopted: RESOLUTION. Whereas, at the special meeting held by the board of county commis sioners of the county of 'Kandiyohi and state of Minnesota on April 30th and May 1st, A.D. 1906,for the hearing and examination of viewers' report on file in the auditor's office of said county, in the matter of the public ditch petitioned for by A. J. Abbott and others, and designated as County Ditch No. 23, the said board did ex amine said report and did hear all interested persons present relative to the establishment of said ditch, to gether with the viewers appointed thereon, found that the said viewers' report was defective and erroneous in this: Lot. That the benefits assessed to the following real estate appearing in Exhibit I of Viewers' report as Lot 3 to 8 inclusive and southeast quarter of southeast quarter of section 26, township 119, range35, and the lands owned by Asa J. Abbott, are exces sive on account of lands included to be benefited by drainage of said ditch will not be wholly drained and added to the lands of said Asa J. Abbott 2nd. That the viewers neglected to consider lots 6 and 12 of lots 3 and 4 of section 32, township 119, range 34, either as to benefits or damages occa sioned by the said ditch running through same, and it appeared from the evidence of John Bergquist, own er, that said tract of land will be damaged by said ditch Therefore, be it Resolved, That the viewers' report be and is hereby re ferred back to the said viewers to make the necessary corrections in said report, and 10 correct the aforesaid defects and errors therein and to forthwith report the same corrected to the board of county commission ers. On motion the hearing in the mat ter of proposed Oountv Ditch No. 23 petitioned for bv A. J. Abbott and others, was adjourned until 9 o'clock a. m.. May 2nd. 1906. The Board convened on Mav 2nd. 1906. at 9 o'clock a. m. All members present. The matter of the petition or A. J. Abbott and others for,a conntv ditch( No. 23 was taken nn. Beoort of viewers in said matter, as amended bv said viewers, was read and considered. On motion a recess was taken un til 1 o'clock p. m. The Board met at 1 o'clock p. m. All members present. The matter of the petition of A. J. Abbott and others for a uublio ditch (Oountv Ditch fto. 23) was again taken un and considere.1. Moticn was made and seconded that the engineer and viewers' renorts in the said matter be accented and petition granted. Motion carried unauimouslv. The following order was thereunon issued and adopted. TO ESTABLISH DITCH. State of Minnesota, County of Kandiyohi, ss. In the Matter of the Petition of A.J. Ab bott and Others, for a Public Ditch in the County of Kandiyohi, State of Minnesota, Designated ami-Numbered as County Ditch No. 23. The above entitled matter came on duly to be heard by and before tbe Board of County Commissioners of the County of Kandiyohi, State of Minnesota, at a spt clal meeting of said Board duly called for the purpose of hearing and considering the petition for said ditch in the above entitled matter, on tbe 3d day of May, A. D. 10O6. at 2 o'clock P. of said day: the said meeting being an ad journed meeting of that special meeting of said Board duly called for the purpose of hearing and considering the petition lor said ditch in the above entitled matter on the 30th day of April, A. D. 1906, at 2 o'olock p. m., of said day, which meeting was ad journed on account of and for the reason that the viewers' report therein was defect ive and erroneous and a re-reference to them was made to remedy such defect and errors, and ic appearing by proper evidence that due notice had been given of the pendency of said petition and of said time of hearing thereon and that John S. Day, the Civil En gineer appointed by this Board to survey the route of said ditch, has completed his work and duly filed his report thereon in the office of the County Auditor of said County, and that the Viewers appointed by said Board to view and report upon said work have duly completed thtir labors and made and filed their report in due form of law in the office of said County Auditor, the said Board of County Commissioners did, at the time above specified,proceed to hear said petition and snid Viewer's report thereon and said Board having duly considered said petition and heard all the parties interested for or against the construction of said ditch and all other matters pertaining thereto, find as foil tws, to-wit First. That the said Civil Engineer has completed his work and made and fikd his report thereon in all respects according to law. Second. That the Viewers appointed here in have duly completed their labors and have made and filed their report thereon ac cording to law. Third. That the estimated benefits be derived from the construction of said work are greater than its total cost including damagts awarded. Fourth. That the damages and benefits arising from the construction of said ditch have been duly awarded and assessed, and that said work will be of public utility and promote the public health and that said re ports of said Engineer and Viewers are com plete and correct. Fifth. That notice of this hearing of said Viewers' report and said Engineer's report has bien duly given, published and posted and mailed as by law required, and that proofs of said service of said notice have Ixen duly made and filed in the office of the Ctmnty Auditor of said County, and that all other proceedings in the matter have been made and taken in accordance with the pro visions of la^ Now, Therefore, as conclusions from the foregoing findings, we, the Board of County Commissioners of the County of Kandiyohi, State of Minnesota, at said special session of said Board, held at the time above specified, being satisfied that the proposed ditch will be ot public utility and conducive to public htaltu and public benefit and convenience, do hereby locate and establish the said ditch according to the report and the specinca uons ol said Civil Engineer made and filed herein, and do hereby establish and confirm the report of the Viewers made and filed herein. The above entitled matter came on duly to be heard by and before the board of county commissioners of the county of Kandiyohi, State of Minne sota, at a special meeting of said board duly called for the purpose of hearing and considering the petttion for said ditch in the above entitled matter, on the 1st day of May, 1906, at 2 o'clock p. m. of said day, which meeting was adjourned until May 2nd, 1906, at 8:30 o'clock a. m., and again adjourned until May 3rd, 1906, at 9 o'clock p. m., and it appearing by proper evidence that due notice had been given of the pendency of said petition and of said time of hearing, thereon, and that George A. Ralph, the civil engineer appointed by this board to survey the route of said ditch has completed his work and duly filed his report thereon in the office of 1 he county auditor of said county, and that the viewers appoint* ed by said board tojview and reports upon said work have duly completed their labors, and made and filed their report in due form of law in the office of.said county auditor, the said board of county commissioners did, at the time above specified, proceed to hear said petition and said viewers' report thereon and said board having duly considered said petition and heard all the parties interested for or against the construction of said ditch' and all other matters pertaining thereto, find as follow?, to-wit FIRST: -That the said civil engineer has completed Jiis work and made and filed his report thereon in all respects according to law. SECOND: That the viewers appoint ed herein have duly completed their labors and have made ana filecL their report thereon according to law. FIFTH: That notice of this hearing of said petition and of said Viewer's report and said Engineer's report has been duly given, published and posted and mailed as by law required, and that proofs of said service of said notice have been duly made and filed in the office of the County Auditor of said County, and that all proceedings in the matter have been made and taken in accordance with the provi sions of law. Now, Therefore, As conclusions from the foregoing findings, we, the Board of Countv Commissioners of the County of Kandiyohi, State of Minne sota, at said Special Session of said Board, held at the time above speci fied, being satisfied that the proposed ditch will be of public utility and con ducive to public health and public benefit and convenience, do hereby locate and establish the said ditch according to the report and specifica tions of said Civil Engineer made and filed herein and do hereby establish and confirm the report of the Viewers made and filed herein. It is Further Ordered, That the damages awarded to the persons and corporations named in the Viewer's report herein, in excess of benefits, be paid out of the countv treasury oi said County on warrants to b^ drawn and attested by the Auditor of said County and signed by the Chairman of this Board of County Commis sioners, and delivered to the persons entitled thereto as provided by law. Petition of Tobias Aanenscn and others for a countv road in towns of Oolfax and Buibank, which was set for hearing at this session of the board was taken UP. and bearing dulv haa. after which on motion, the eaid petition was granted, and the follow ing orderJssued and adopted: ORDER OF HEARING AND AP- POINTMENT OF COMMITTEE FOR COUNTY ROAD. State of Minnesota, ss. County of Kandiyohi. Whereas, On the 2nd day of May, 1906. a petition signed by twenty-four freeholders of said county was pre sented to us praying for the establish ing of a highway running into mor* than one town of said County, and not within the limits of any incorpor ated city, and described as follows: Beginning at the Southeast corner of the Nqrtheast quarter of the Northeast quarter of section Twelve (12), Township One Hundred Twenty two (122), north, of range Thirty-five (35) west, running thence due North Four Hundted (400) rodson the Town line between Township One Hundred Twenty-two, (122) north, of Range Thirty-five (35) west, and Township One Hundred Twenty-two (122) North of Range Thirty-four (34) west, and to be connected with other roads as follows: At the point where the new road is to start, it connects with the public highway running east and west, about forty (40) rods jvest of the Crow River church. At the terminating point it slull connect with the public high way running to Belgrade, and termi nating at the Northeast corner of section one (l)i Township One Hun dred Twent two (122) north, of Range Thirty-five (35) wet, and the Board of County Commissioners of said County having determined that in the judgment of a majority of irs members said petition is reasonable on its face It is Hereby Ordered, That a hear ing be had on said petition at the County Auditor's office in a id County, on Monday, the 9th day of July, 1906, at 2 o'clock P. Now, therefore, it is ordered, that said pe tition will be heard bv this Board at the session thereof commencing on the atn day of July, A. D. 1906, at the office of the Coun ty Anditor in said County. A Four petitions were presented, each •lianed hv a number of residents from tbe vicinitv of Lake Waconda. nrav ing that the Board of Oountv Com missioners as "soon as nossible open the outlet from Lake Waconda and remove all obstructions in the ditch between Lake Waconda and Big Kan divohi Lake, and maintain same ac cording to law All the petitions were read, and a number of interest ed parties apppared before the Board and were heard relative to the mat ter. On motion action on the said oeti tion was deferred until later. Commissioner N. B. Johnson offer ed the following resolution and mov ed its adontion. "Whereas it is necessary, in the opinion of the board of county commissioners of the county of Kandiyohi in order to defray the expense incurred in locating, construct ing and establishing Judicial Ditch No. 3 aid county, that the county ot Kandiyohi 'in the state of Minntsoti should issue its bonds in the aggregate amount ol $34 117.00 and obtain a loan of that amount thereon, and said county desires to make an applica tion to the state of Minnesota therefor. Now, therefore, be it resolved, by the board of county commissioners of the county of Kandiyohi that the county of Kandiyohi hereby mukes application to t» state of Minnesota for a lo^n of $34,117 OO upon the bonds of said county, to be used in decaying the expense incurred in locat'ng, construct ing and establishing Judicial Ditch No. 3 in the county of Kandijohi and'that the bonds of said county of Kandiyohi bearing interest at the rate ot 3 per centum ptr annum, in the sum of $34,117.00 be, and they each are, hereby issued and ordered issued, payable as follows: One bond for $17,0S9 OO paya le July 1st, 1912. One bond for $17,058 OO payable July 1st, 1915, and that the chairman of the board of county ccmm,ssioner&of said county and the auditor of said County, be and thev each are hereby authorized and directed to make, txecute and del ver, on behalf of said county all said bonds, and with the other officers of said county, all other necessary papers in connection therewith," which motion, being seconded by Commissioner Aug. Anderson was put to a vote and carried and so declared by the chairman then presi ing. Commissioner Th. Olson offered the following resolution and moved its adoption: "Whereas it is necessary, in the opinion of the board of county commissioners of the county of Kandiyohi in order defray the expense incurred in locating, constructing and establishing Judicial Ditch No. 1 in said county, that the county of Kandiyohi in the state of Minnesota should issue its bonds ia the aggregate amount of $6,886 OO and obtain a loan of that amount thereon, and said county desires to make an application to the state of Minnesota thrrefor. Now, therefore.be it resolved, by the board county comtn missioners of the county of Kandiyohi that the county of Kandiyohi hereby makes application to the state of Minnesota for a inan of $6,886.00 upon the bonds of said county, to be used in defraying the expense incurred in locating, construct ing and establishing Tudicial Ditch No 1 in the county of Kandiyohi and that! the bonds of said county of Kandivohi bearing interest ,at the j-ate ot 3 per centum per annum in the sum of $6,886.00 be. and that each are hereby issued and ordered issued, payable as follows One bond for $3,443.00 payable July 1st, 1912, 1 One bond for $3,443 OO payable Julv 1st, 1915. and that the chairman of the board of county commissioners ot said county, and the Auditor of said county, be atid they are hereby euthorzed and direc ed to make, execute and deliver, on behalf of said county, all said bonds, and with the otheY officers of said county, all other necessary papers in connection therewith," which motion (being seconded bv Commis siomr T. Tallman has retired from the telephone business, having sold all his interests in both the Minnesota Cen tral and the local exchange. His time will be devoted to the Dakotan and Canadian development companies in which he is interested. Mr. and Mrs. C. P. Carl and their two children, former residents of Will mar, were among those who went thru the harrowing experiences of the San Francisco earthquake. They returned to Ortonville April 27, at which place they have been residing since leaving Willmar. W. W. Knight, manager of the Litchfield Tubular Well Co., is busy putting in wells in the city. He drove two wells in block 80 a few days ago, taking about one hour's work for each well. Parties desiring work in that line will do well to see Mr. Knight about the work. W. Rose has closed his meat mar ket business on Third street and says that he will now engage in the busi ness of buying and selling cattle, to which he will devote his entire atten tion. His place of business will be remodeled and he will occupy it as an office and still make his headquarters there. Rev. G. L. Morgan, of Windom, will hold evangelistic services at the English M. Under the new code, every time a church-denomination con ducts a raffle it violates .the law and commits a penitentiary offense. The time honored raffle, with its chances on cows, quilts, clocks and other ar ticles must be tabooed, and the per-, son who takes a chance is liable to be sent to prison for two years or pay a fine of $1,000. Any person selling tickets for a lottery is guilty of a mis demeanor. The law on, this subject is as fol lows: "A lottery is a scheme for the dis tribution of property by chance among persons who have agreed to pay a val uable consideration for the chance, whether it be called a raffle, lottery, gift enterprise or by any other name, and is hereby declared unlawful and a public nuisance. Every person who shall contrive proposes or draw a lot tery, or shall assist, shall be punished by imprisonment in the state prison for not more than two years, or by a fine of not more than $1,000, or both." —Fairfax Standard.
