An Ordinance entitled “An Oulinance For The Construc tion And Laying Of Concrete Side Walks On Certain Portior- 0' Certain Streets in The City Of Pr< -eott, Ark ansas.’’ Be It Ordained By The City Council Cf The City Of Prescott. Arkansas: Sec. 1. That a concrete sidewalk be laid and constructed in the manner hereinafter provided by the owner or owners of the real property described ar d abutting upon the streets as fol lows : Upon theSouth side of Block Fif teen, Railroad Survey, from West Sec ond to West Third Stree; upon the Fast side ot Block Four, Railroad Sur vey, from Walnut Street to Main Street; upon the West side of Block Twelve, Railroad Survey, from Elm Stree to Main Street; upon the North side of Blocks Thjrty-six, Thirty-nine and Forty-four from East Second to East Fifth Street; upon the North side of Blocks Fighty-four, Ninety seven and One Hundred and One of Bradd Scott’s Addition, extending from in near East Seventh Sturt t where walk is now laid, to the Corporatien line; upon the East side of Lots hour. Five, Six and Seven of Block Sixty, Loughborough and Knoble’s Addition, extending from the entersection of East Second Street to the Corporation Line; upon the East side of Blocks Forty five, Forty six and Forty-seven, Railroad Survey, extending from Fast Main Strut t to Laura 1 Street; upon the West side of Lot One, Block Thirty five, Brad Scott’s Addition, along East Second Street. Sec. 2. That the concrete sidewalks to be put down and constructed on portions of the streets described in SECTION ONE of this Ordinance shall be put down, laid and constructed as to grade, according to the lay or natural 1 ise and fall of the abutt.ng prop erty, -provided that this shall be uni form ar d gradual from the cornet of street to street, and with not to ex ceed one rise and one fall between streets. Sec. M. That the sidewalks as herein directed -hull be laid and constructed in the following manner and out of the following mat* rial: That a good and substantial founda tion shall first be made and provided for said projtost u sidewalks, by provid ing a solid bed for that purpose and to that end; that upon and above said bot tom tilling shall be a grouting to con sist of on» part of PORTLAND CEM ENT, two parts of torse sand and three parts oi clean gravel or crushed stone, the whole to be prop rly mixed and well tamped; that m \t upon and above said grouting there si.ail be constructed a finish of one inch thic ness, and said finish to consist of two parts of PORT LAND CEMENT and three parts of sharp, coarse sand; that the top or sur face of said proposed sidewalk shall have a uniform fall or downward slope from the inside to the outside thereof equal t<> one fourth of an inch to each foot Sec. 4. That it the owner or owners | of any property facing, adjoining or ! abutting on that portion of the streets named in SECTION ONE of this Ordi nance shall fa 1 or refuse to comply with the prove-ions hereof, in the man ner and within the tune herein provid ed, the CITY OF PRESCOTT shall, after giving twenty days notice in writing to the said owner or owners, or to the agent in charge of the said property,of i is intention to do so, contract with ! some suitable person for the construc tion of said sidewalk on the best terms that can be made, and in the manner hereinafter prescribed by this Ordi nance, and that the said CITY OF ! That the said sidewalks shall be constructed upon the portion of streets described in SECT ION ONE oi this Ordinance, and in th manner as specified herein, within six months from and after the passage and publication of this Ordinance. Sec. 7. That should the owner or owners of said property abutting on the streets as hereinln fore described, fail oi refuse to construct said side walk in th* manner and within the time as hereinbefore provided the CITY OF PRESCOTT shall, ai'er giving the notice prescribed bj SECTION FOUR of this Ordinance, contract through the Street Commit tee, in writing, with some snitable person, for the construction of said sidewalk on the best terr as that can be iiad; PROVIDED that said contract trade by said Committee shall be ap proved by the (TTY COUCIL. Sec. S. That all ordinances and parts of Ordinances in conflict her* with are hereby repealed and this Ordinanc* to take effect from nd after its pas sage and legal publication.
