An eminent authority, who is fully advised in the matter, has writ ten us a letter In which the animus of the litigation is expllcltely shown, and for the purpose of correcting any misapprehension that may have per meated the grey matter of our read ers the epistle is herewith repro* j duced: 'ln your Issue of February 19th, under the heading Otero Reservoir in Court.* the article would intimate that Hie matter of storing water in the Clear Creek reservoir is in liti gation. The litigation referred to is solely over the right of the Otero canal to store the waters of the Jackson ditch, n small canal with a priority for about five cubic feet per second which irrigated the tract of land, or a part of it. which Is now submerged by the reservoir. In view of the fact tiiat It Is impossible to farm this laud any longer, and in view of the ownership of the priority by the Otero irrigation District, appli cation is being made to transfer this right from a right of use to a right of storage. “Tills matter is 1 elng opposed by some members of the Arkansas Val ley Ditch Association solely on the grounds that It may be a bud preced ent to change rights to use of water to storage, because water used oti * land returns in a more or less de * gree to the stream from which It is taken during the time the water is being us«-d. There is no controversy ' whatever as to the right of Uie Clear Creek reservoir to store water either * during the winter season or during * the summer floods The amount of 4 water Involved in the Jackson ditch r controversy is very small and the op * position to the measure is. us above stated, solely on the grounds of the 4 wisdom of establishing stub a pre -1 cedent." * Some Property Sales. C. 1" Helm, of the Arkansas Valley Realty Company, reports quite a num ber of sales of property this week, among them being the following: I Mrs. Charles A Lewis bought the four room cottage on South Bellertew avenue, in the Otero addition, which was owned by Mrs. Delia R Hunder-, t man. of Chicago.
