SWAIM'S MEMORY. He Does not Recall the Statements Made by II is Recent Banker, Bateman. Washington, May 18. —In the Swaiin court of Inquiry to-day Qen. Swaiin continued his testi mony, lie ?aiil he could not understand the Btatement furnished him by the bank. A time was fixed, witness said, when they could get to- L'eUier 01. Sunday afternoon fand go over the ac counts, but though witness was at the place of meeting within ten minutes of the time fixed, Bateman did not appear. With respect to the assignment of a due bill for $5,000 to Bright li Humphrey, witness testified that not being able to secure a satisfactory statement of his financial relations with Bateman, he determined to have them seitle.L by menus of a due bill. Xot desir ing the notoriety of suing in his own name on tiie due bill, witness transferred it to Bright & Humphrey to whom he was in debted for the erection of his house. The witness explained to Humphrey that he had a long running account with Bateman which he Bupposed he could only have settled by suing. The witness asked Humphrey if he would take the note and collect whatever was due on it. Humphrey agreed to do so if the ex pense of the suit was met by the witness. Wit ness turned over the due bill to Humphrey, wliose attempts to collect it have already been shown. When Humphrey failed to get satisfac ■ni Bateinan, lie authorized the witness to :;,.■ name of Bright £ Humphrey, ami wit ne: s authorized Col. Johnson, as his attorney, to commence this suit. Witness directed that his suit be tiled on Ihe last day of the term. When the subject came up Bateman proposed to leave it to John W. Thompson, Major Butterworth or Col. Parker, and Commissioner Butterworth was determined upon and an agreement at once drawn up, wit reeing to get the due bill from Bright & Humphrey and turn it over to M. M. Parker. Batemau then said since they had this talk he \-.-m\ concluded that witness had not intended to defraud him, as he learned he had some offsets against the due bill in the suit brought on it, whether it was in the hands of Bright & Humph rey s, or of witness, and he would withdraw the chargi she had made. Witness said he then told Bateman that the latter must exonerate him (witness) from all accusations of frand, that he asked him, "Do you believe thai 1 would de fraud yon out or valuation?" That Bateman replied he did no) believe and that they then axed up a letter, which Bateman sent the secretary, withdrawing the charges. Witness then stated that in his endorsement upon Secre tary Lincoln's letter, he had intended to deny absolutely and completely every accusation of fraud or attempt at fraud or knowledge of, or connection in any possible manner with the negotiation of fraudulent pay accounts. He said he had thought the most positive denial he could make, was 10 state the facts as he remem bered them in all the transactions rather than to content himself with a plain denial. His en dorsement was thus, he thought, a specific denial, Witness that he had in the talk about abitration agreed to surrendered the due bill to Bateman, as. asserted by the latter in his testimony and al-n denied another statement by Bateman in his testimony, that he had consulted with the Witness about arrangements for a settlement if CoL Morrow's pay accounts. At this point the witness was turned over to Chandler for cross-examination. He was rigorously ques tioned as to his knowledge of the standing o£ his accounts with Buteman & Co., particularly with reference to certian differences between the state ment prepared at Swaim's direction and the state ment of those accounts furnished him by the firm. Chandler pointed out two transactions in the books which appeared in the statements furnished by the firm to Swaim, in which Swaim was charged with losses which did not appear in Swaim's statement submitted in evidence. Wit ness said in his transactions he could not have seen whether there had been any such, but would not say there had not been, lie said his state ment had been made up from notices sent him by the firm of transactions in stocks on his ac count. He had no recollection of ever having noticed the report of the tranaac tions referred to the statements furnished by the lank, al though they were written down in those state ments. Witness admitted he had had money on deposit in the bank as margins to be appropri ated to the payment of losses if he sustained them, and to be increased by his gaius if he did gain. Pending a discussion between counsel as to certain admissions made by Calkins With re spect to the negotiability of the $5,U00 due bill. The court adjourned. DEATH OF CHARLES O'CONOR. His re mains leave to-day for Xew York. Charles O'Conor was born iD New York in 1804 Shortly before his birth his father emigrated from Ireland, aiiJ soon after his arrival lost a hand some property which he inherited. This prevent ed tin- son from receiving a liberal education; but he learned at school the primary English tranches, and received some instruction in Latin from his father, lie studied law, and in 1884 was idmitted to the liar. His !irst reported argument it- in the case of Diwer vs. -McLaughlin .n the supreme court in 18:2!). His most notable cases are the Slave Jack rase (1835), the Lespenerd will case (1843), the For rest divorce case (1851), the Mason will case ( 1853), the Lemmon slave case (1850), the Parish will case, (lHii-J), and the litigation concerning the Jumcl estate; ami he has been employed in many other important cases, many of which in volved sinus varying from from $100,(100 to mil lions. He was proniinnet in prosecuting the so called "Tweed ring" case s against the late mu nicipal officers of Xew York, in 1873. A zealous Democrat, he was repeatedly urged by his party to accept nominations to the highest offices, but refused. He consented to serve for fifteen months as United states district attorney for New York. under President Pierce, and was a member of the Xew York state constitutional convention of 1846 and 18(14. He was nominated for the presidency by the Labor Reform convention in Philadelphia August H, 1572, and by the so-call ed Straight-out Democrats in Louisville, Ky. September 3, the same year. He declined both nominations, hut in the.subsequent presidential election received 2!),-189 votes. He was a man of spotless integrity and purity of private and pub lic life. At the ripe old age of four score years he leaves the scene the last of that brilliant co terie of legal minds which for nearly half a cen tury adorned the Xew York bar. In criminal jurisprudence Charles O'Conor prcbably had no peer. In religious belief he was a Catholic. Ancient Order of Hibernians. Cleveland, May 13.—The thirty-fourth annu •l national convention of the Ancient Order of Hibernians began to-day. Delegates were pres ent representing twenty-nine states and four ter ritories. There was a parade this morning. They at!elided high mass at the cathedral and heard the annual sermon by Father Thorp. Prelimina ry business of. the session was held at noon. Hon. Jeremiah Crowley, of Massachusetts, was in tin-< hair. In the afternoon they visited Gar field's tomb. There is a banquet to-night at Weis garber's hall. The session continues four days Homoeopathists in Council. Cleveland, May 13.—The twentieth annual session of the Ohio Homoeopathic Medical society began to-day with President J.C.Sanders, of Cleveland, in the chair. Routine business was transacted, and papers presented on clinical med icine, pedology, registration statistics, sanitary science and materia medica. In the afternoon the society visited Qarfleld's tomb. In the even ing there was a banquet. No Restricted Quotations for St. Louis. St. Louis, May 18. —The question whether the Merchant's exchange, of this city, sna jj rece i ve the Chicago market quotations under the res trictions imposed by the board of trade of that city, was voted upon by the exchange and result ed in its defeat by a vote of 245 for to, 403 against. The exchange will therefore not receive the Chicago quotations unless some other terms are agreed to. Wants to Blow Them Up. Dublin, May 13.—The authorities have re ceived anonymous threats of attempts to destroy the Nelson column, which is constantly guarded. The lock on the gate on the Ship street entrance to the castle yard is destroyed. A laborer named McGinn was discovered within the pre cincts of the castle, having a bag with several pounds of gunpowder, with a long fuse. The man was arrested and sentenced to three months.
