cial Circles in the City of
Brotherly Love.
New York, June S.— Through the at- I
torneys of Count Eugene de Mitkiewitz,
ootids city and Philadelphia, a com
print was filed to-day in the court of \
common pleas of Philadelphia against
Wharton Baker, the Philadelphia cap- ;
italist, to compel a specific performance '<
of agreements of gigantic proportions ■
under concessions by the Chinese gov
ernment, to supply the whole of the
Celestial empire covered by treaties
with telephonic service, through a com
pany of a capital of 50,000,000, and to
form another company with a capital of
(36,000,000. with general banking, rail
roading and mining powers, also under
concessions from the Chinese govern
ment.
The complaint sets forth that prior to
March, 1887, the plaintiff and William
L. Paine, at great trouble and expense,
succeeded in securing the support of
the Chinese minister, Hoon Chang. The
following agreement was then made: A
company was to be formed to supply
the empire
WITH TELEPHONE SERVICE.
Plaintiff was to have three-twentieths
of the stock, defendant thirteen-twen-
x *jeths and Paine four-twentieths. It
«?as to be called the American Tele
phone company and 11,000.000 worth of
stock was to be limited to Chinese sub
scriptions. The remainder of the stock j
was to be held by a company, capitalized
at $20,000,000. to be called the Oriental
company. This company was to have
banking:, railroading and mining pow
ers, and a concession of such a grant
was promised by Li Hung Chang. On
this promised concession provisional
certificates of stock were issued over
'he signatures of the plaintiff and de
fendant to Chinese officials. Mean
while, an embassy was sent to the Uni
ted States, in which was envoy. Ma Kie
Chang, to see Barker and arrange mat
ters, The complaint says that Chang was
taken to the country house of Barker
and treated sumptuously, and that the
outcome was thai a new arrangement
was 1. aile whereby the plaintiff was
left out in the cold, and between

ler a subscription of $100,000 was raised
to meet the expenses of ~
THE CHINESE ENTERPRISES,
Barker representing that he was the
sole grantee of these concessions. An
agreement was then made whereby
Barker was allowed to sell one-fourth
of his interest in the American & Ori
ental company for 25 per cent of the
par value. One-fifth of the proceeds
was to he paid to the treasurer of
the latter company. The remainder
was to go to the owner. An agreement
was then made to form the Finance
Company of Pennsylvania with a capital
of $5,000,000. All the stock to be paid
up and each stockholder to be given
part of the stock of the American and
Oriental companies. All of the agree
ment Barker has failed to fulfil, ac
cording to the complaint, although
pressed to do so by plaintiff and Mr.
Paine. Although Barker claims the
concessions were repudiated by the
viceroy, it is claimed Barker repre
sented otherwise to induce the $100,000
subscription.
The plaintiff alleges that through Mr.
Barker's failure, to carry out these
agreements he has not been able to
fulfill his promises to the Chinese
officials and that distrust- has been en
gendered which imperils the scheme.
The wealth and high social standing
•of Mr. Barker ami others associated
with him lends an additional interest to
the litigation.

"Robinson, an aged farmer of Newton,
Ark., went crazy on the train coming
from Paducah this morning and created
a reign of terror among the passengers.
lie was traveling with his wife from his
home to a visit to his brother at Beria,
Ky. He had just recovered from brain
lever and the trip was to afford a
change. While sitting by his wife, an
hour after the train left Paducah, he
suddenly began to yell, and when his
wife tried to quiet him, he seized her
and was about to throw her from the
open window of the living car. Passen
gers interfered and he turned upon
them, and was only seemed after a
sharp struggle. He was chained to a
seat, and when he arrived here was
foaming at the mouth and tnggine at
his shackles. Bis brother was notified
by wire. His wife is prostrated by the
shock.

ment of benefits, costs and expenses
arising from the grading of Marshall
avenue, from Victoria street to the edge,
of the bluff near the Mississippi river,
in said city, as to ownership, description
of and amount assessed against tiie fol
lowing described property, to-wit:
That part of the northwest >£of north
west }i of section 3, town 28, range 23.
lying northerly of the right of way of
the Chicago, Milwaukee & St. Paul
Railway (short line so-called), being in
St. Paul, Minnesota.
Also as to ownership, description of
and amount to be assessed against the
following described property, to-wit:
That miscellaneous piece of land forty
feet in width, between Marshall avenue
and Pascal avenue, lying next southerly
of and parallel with the right of way of
the Chicago, Milwaukee & St. Paul
Railway company, being in St.Paul,
Minnesota; so as to conform to the facts
and rights of the case as intended. „
All persons interested are hereby noti
fied to be present at said time and place
of making said correction, and will bo
heard.

in the sum of at least twenty (20) per
cent of the gross amount bid must ac
company each bid.
