tionee is the sole executor named in said last
will and testament, and praying that the

1»I T. Wick, mortgagor, did on the 7th
day of February, 1887, execute and deliver
to William It. Sacbe, Edmund T. Somers and
William A. Soniers, mortgagees, a certain in
denture of mortgage, bearing date on said
7lh day of February, 1887, to secure the pay
ment of the sum of two thousand dollars and
interest according to the conditions of two
certain promissory notes, each for one thou
sand dollais, due respectively in one and two
years from said 7th day of February, 887,
with interest annually before and after
maturity, until paid, at the rate of eight per
cent per annum, at the office of Somen &
Sacbe, in St. Paul. Minnesota, and given to
secure the payment of a part of the pur
chase money of the mortgaged premises
hereinafter described, whereby said mort
gagor did grant, bargain, sell and convey to
said mortgagees their heirs and assigns, the
following described land and premises, situ
ate in the city of St. Paul, county of Ramsey,
and state of Minnesota, to wit: Lot num
bered four (-1). of Block numbered sev
enteen (17), of Brooklynd, according to
the plat thereof on file and of record in
the office of the Register of Deeds in and for
the county of Ramsey aforesaid; which said
indenture of mortgage, duly acknowledged,
was on the sth day of March, 1887, at 4
o'clock ln the afternoon, duly recorded in
Ihe office of the Register of Deeds aforesaid,
in Book "160" of Mortgage Deeds, page 45;
and, whereas, the said mortgagees did on the
21 lb day of Match, 18*7, for a valuable con
sideration, execute and deliver to Caroline I.
Mervine an instrument in writing whereby
they did grant, bargain, sell, assign, transfer
and set over the said mortgage and the debt
thereby secured to the said Caroline I. Mer
vine, her heirs and assigns, which said as
signment was on the 22d day of October,
1887, at 12 o'clock and 15 minutes in the
afternoon, duly recorded in the oflice of the
Register of Deeds aforesaid, in Book • l R" of
Assignments, on page 519;
And, whereas, said mortgagor did cove
nant and agree in and by said mortgage In
case of a foreclosure thereof to pay said
mortgagees, tlirir heirs or assigns the sum of
seventy- five dollar-, attorney's fees;
And, whereas, the said mortgagor did on
the 21st day ot February, l*^ - -. also execute
and deliver to said Caroline I. Mervine, as
signee of said mortgage and said notes, an
Instrument in writing whereby said mort
gagor promised and agreed to pay her inter
est at the rate of 10 per cent per annum on

forbearance, and that she. said assignee,
would extend the time of payment of said
