It is hereby ordered by the Common Council of the City of St. Paul, that the Board of Public Works of the City of St. Paul, cause the following- improve ment to be made, to-wit: Pave with vitrified brick upon a concrete foundation. East Seventh street, from Hope street to Phalen avenue, including those portions of said street between the lails of each street car track and between the lines of double track, and for a space of two feet outside the outer rail of each of said tracks on either side thereof, ami including also the curbing of said street between the points named, with granite, and the necessary gas, water and sewer collections, to the property lines. That the St. Paul City Railway Com pany be and it is hereby notified and or dered forthwith in accordance with the terms and provisions of Ordinance No. Illi. to cause to be paved with vitrified brick on a concrete foundation, all the same kind, quality and manner of con si ruction as the remainder of said street above mentioned, that portion of said East Seventh street from Hope street to Pha len avenue. between the rails of each of its tracks on said street and between its lines of double track, and for a space of two feet outside the outer rail of each of said tracks on either side thereof, with the privilege, however, of using granite toothing along the rail edges if it shall so desire. That the Board of Public Works be, and it is hereby directed, to advertise for and receive separate bids for the pav ing of the aforesaid portion of said street, between and along.said tracks, including the said space of two feet outside of the outer rail* of each of said tracks as afore said, at the same time the bids for pav ing the remainder of said street are re ceived, and if the said St. Paul City Rail way Company shall fail for a period of ten days after the approval of the award of the contract for the paving of said street, to file a written acquiescence with the acceptance of the terms hereof with the Board of Public Works of the City of St. Paul, and thereafter to commence and speedily and continuously prosecute the work of paving required to be done by said company as aforesaid, that said Board of Public Works cause said paving to be done under the contract for paving the rest of said street, between said points and as part thereof, and that in that case the Board of Public Works be and it is hereby required to assess the ex pense thereof as provided by law upon the said St. Paul City Railway Company. i hat in any event, said Board cause all of said work to be let by contract as pro vided by law without one-half the estimat ed cost being first paid into the City Treasury. The said contract in so far as it shall relate to those portions of said ?<-* cct to .ibe Pave<l by the said-St. Paul City Railway Company, as hereinbefore referred to. to be conditioned, however upon the failure of said.company to com ply with the terms, and requirements of this order, and after said work shall be placed under contract, said Board shall proceed without delay to assess the amount as nearly as they can ascertain the same, which will be required to pay the costs and necessary expense of said improvement, except, however, that por tion above referred to as required to be done and performed by the St. Paul City Railway Company, and excepting also the sum of Ten Thousand Dollars, which has heretofore and under and pursuant to the terms of the preliminary order ap proved January 17, 1903, been appropriat ed out of the General.
