Ay F No. 7197—Ordinance No. 2397—8y Mr. Rosen— An Ordinance granting to the Chicago Great Western Railway Company the rifrht to construct, maintain and oper ate railway tracks over and across certain streets and on certain alleys, in the City of St. Paul, Minnesota. The Common Council of the City of St. J';n:l do ordain as follows: SECTION 1. Permission is hereby granted to the Chicago Great Western Railway Company, its successors and assigns, to construct, maintain and operate one or more railway tracks, not exceeding three (3). together with the necessary turnouts and crossovers over and across the fol lowing named streets and on the follow ing described alleys in the City of St. Paul, Minnesota, namely: Robert court (formerly Wright street), Morrison ave nue. Plato avenue. East Chicago avenue, East Indiana avenue. East Fairfleld ave nue, East Fillmore avenue, and the al leys in blocks twenty-three (23). eigh teen (IS), fifteen (15). ten (]0) and seven <7) of Bazille & Robert's addition to West St. Paul. Provided, however, that nothing hereii* contained shall be construed to take away or abridge the power of the City to regulate the use of the said strict crossings, or abridge or modify any State Law regulating the care, con struction and management of railroad crossings, and Provided, however, that the grades of said tracks shall be on the same grades as the present established grades of said streets and alleys, and that the tracks hereby authorized to be constructed shall be put in under the direction of the Com missioner of Public Works of the City •>f St. Paul in such manner as he shall direct, and the rails thereof shall not be higher than the top of the sur face of the ground, and said Railway Company whenever required by the Com missioner of Public Works, or directed so to do by the Common Council shall plank in such manner as shall be directed, the space lying between the rails of said tracks and for a space of at least two (2) feet outside of each rail of said tracks, and keep and maintain the same in proper condition. Provided, further that the authority and permission hereby granted is upon the further condition that when any pav ing shall be ordered by the Common Council upon any street upon, along or across which the tracks hereby author ized are laid, the said Railway Company shall in like manner and with like ma tt rials, at its own cost and expense, pave such parts of any and all such streets as may lie between the rails of each track and between the lines of double tracks, rind for a space of eighteen inches, on cither side, outside of its track or tracks, where such paving may have been or dered as aforesaid, and in case said Com pany shall, after being ordered so to do by the Common Council, neglect for the space of thirty days to lay and construct such paving-, then the same may be done undor the direction of the City of St. Paul at the expense of said Railway Com pany, and the amount of said expense and the cost thereof shall be assessed by the proper authorities of said City, against the property of said Company, upon like notice and in like manner, as If the same were to be assessed against property of private individuals, and the imount so assessed shall also be a per ?onal obligation of said Company and shall be chargeable to and shall be paid by it. The authority and permission hereby granted is upon the further condition that any and all real property now or hereafter owned by said Chicago Great Western Railway Company, and abutting upon that portion of any of the streets or alleys upon or along which the track <v- tracks herein authorized shall be laid, Khali be liable to the lien of local im provement assessments, and may be as sessed for its proportion of the cost and expense of any and all local improve ments to the same extent and with like effect as if such property were owned by a private individual until said tracks are ordered removed by the Common Council. SECTION 2. The rights hereby granted may be re voked or annulled and said tracks or dered removed by the Common Council whenever in its judgment the public ne cessity shall so require, and in the event of such revocation and . annulment all right and authority of said Railway Com pany to maintain said tracks shall cease and determine, and said Company shall thereupon and within ninety (90) days after the service." upon it of a copy of the resolution, or ordinance directing such removal, take up and remove said tracks. The said Railway Company shall at all times indemnify and save harmless the City of St. Paul from any and all claims for damages on account of any injury to persons or property sustained in consequence of the construction, main tenance and operation of said tracks, and reimburse said City for all sums which it may be required to pay as damages, and for costs and expenses in defending any such claims. SECTION 3. The Chicago Great Western Railway Company shall within thirty (30) days after the passage and publication of this ordinance file with the City Clerk in the City of St. Paul its written acceptance thereof; otherwise this ordinance shall have no force or effect. Said tracks shall cross Custer street : and Starkey street from block four (4) to block six (6) of West St. Paul proper, and Channel street from block- six (6) to block one hundred sixty-eight (168) of said West St. Paul proper. - Provided, however, that nothing herein . contained shall be construed to take away or abridge the power of the City to regu late the use of saw street crossings or nbridge or modify any State law regulat ing the care, construction and ' manage ment of railroad crossings and ' - ■ Provided, however, that the grades of ; Bald tracks shall be on the same grades as the present established grades of said streets and alleys, and that the tracks hereby authorized to be constructed shall be put in under the direction of the Com missioner of Public Works of said City of St. Paul, and -in such manner as he shall direct, and the rails thereof shall not be higher than the top of the surface of the ground, and said Company whenever re quired by the Commissioner of Public Works or directed so to do by the Con mOS Council shall plank ln such manner as shall be directed the : space lying be tween the rails of said tracks ■ and \\, a space of at least. two (2) feet outside o* •ach rail of said - tracks and keep and maintain the same In proper condition, and Provided further, that the authority and permission hereby granted is upon the further condition that when any paving shall be ordered by the Common Council upon any street upon, along or across which the tracks hereby authorised are" laid, the said Railway Company shall in like manner and withlike material, at its own cost and expense, pave such parts of any and all such streets as may lie between the rails of each track and be tween the lines of double tracks, and for a space of eighteen inches, on either side, outside .of its track or tracks, where suoh paving may have been ordered as afore said, and in case said Company shall, after being ordered so to do by the Com mon Council, neglect for the space at thirty days to lay and construct such paving, then the same may be done under the direction of the City of St. Paul at the expense of said Railway Company, and the amount of said expense and the cost thereof shall be assessed by the pro per authorities of said City, against the property of said Company, upon like no tice and in like manner, as if the same were to be i.ssessed against property of private individuals, and the amount so assessed shall also be a personal obliga tion of said Company and shall be charge able to and shall be paid by it. The authority and permission hereby granted i.s upon the further condition that any and all real property now or here after owned by said Chicago Great West ern Railway Company, and abutting upon that portion of any of the streets or alleys upon or along which the track or tracks herein authorized shall be laid, shall be liable to the lien of local improvement as sessments, and may be assessed for its proportion of the cost and expense of any and all local improvements to the same extent and with like effect as if such property were owned by a private indi vidual, until said tracks shall be or dered removed by the Common Council as herein provided. SECTION 2. The rights hereby granted may be re voked or annulled and said tracks or dered removed by the Common Council whenever it shall be of the opinion that public necessity shall so require, and in the event of such revocation and annul ment, all right and authority of the said Company tv maintain said tracks shall cease and determine and said Company shall thereupon and within ninety (90) days after the service upon it of a copy of the resolution or ordinance directing such removal, take up and remove said tracks. It is hereby ordered by the Common Council of the City of St. Paul: That the Board of Public Works of the City of St. Paul cause the following im provement to be made, to-wit: Reconstruct, relay or repair, except where already reconstructed, relaid or repaired, with cement, the present side walks on the following streets, to-wit: A six-foot sidewalk in front of lots 21, 23 and 24, Block 2, Woodlawn Park, in the City of St. Paul. Minnesota. Together with the necessary crosswalks across all intersecting boulevards and alleys on the line of said improvements: That said Board shall proceed without delay to assess the amount, as nearly as they can ascertain the same, which "will be required to pay the damages, costs and necessary expenses of such im provement upon the real estate to be benefited by said improvement, as pro vided by law; it being the opinion of the Council that the real estate to be as sessed for such improvement can be found benefited to the extent of the dam ages, costs and expenses necessary to be incurred thereby.
