But the instructions given to Sedgwick shows that Bayard is far more solici tous that his headlong demand for the instant release of CiUtiuj shall be justi tied in the eyes of the American people than that it shall be complied with. The following points are given us covciiug Sedgwick's orders : That all the evidence and records from the first complaiuts against Cut ting down to the exertion of the Mexi can government that be should have a fair trial shall fully conoborte the ground en which the demand for Cut ting's release was peremptorily made. That it shall be shown that had it not been for the firm and peremptory de mand ot the United States, the course of tbo Mexican court would have been more aibitrary and oppressive than it was. That the whole line of prosecution was changed after the position ot the United States government was empha tically made kuown to tho Mexican authorities. These instructions show tbo hand of the politician, not the statesman. Mr. Bayard fcbow that he is more anxious that his course in the matter blia.ll be justified than that his demand for Cut ting's release shall be compliad with. By tbis very act he throws grave doubt upon the alleged facts upon which he based that demand. Meanwhile, what becomes of Cutting? It evideutly follows that the seuteuce of the court, of hard labor for one year, will have to be served out by him. In point ot tact, it seems tbat there is no legal way in Mexico ot getting him out of jail lor at least several months to come. A Washington paper says that under the federal constitution of Mexico j bo must serve at least two-fifths of his sentence before I'res. Diaz can legally pardon him. Two-fifths of one year is 146 'days, lie was sentenced August 7, and be must remain in prison until Jan uaiy 1, 1887. The immutable fact remains, therefore, that since his conviction and sentence it is absolutely out of the pow cr -of any higher tnbuual, judicial or otherwise, to interfere.
