PUBLIC NOTICE is hereby given that the following proposed ordinance passed a seo ond reading and was ordered to a third and final reading at a meeting of the Board of Street and Water Commissioners held Au gust 28, 1013: An ordinance granting permission and consent to Public Service Hallway Company, Its successors or assigns, to locate, construct, operate and maintain the following exten sion to its street railway system, being a single track extension from tracks now con structed and being operated in Rroad street, over Lafayette street, to and connecting with tracks now constructed and fcefng op erated in Mulberry street, in the city of Newark, county of Essex and State of New Jersey. Whereas. In the Judgment of the Board of Street and Water Commissioners of the r|ty of Newark, public interest and con venience require an extension of street rail way track through Lafayette street, for the purpose of connecting tracks of Public Ser vice Railway Company now in Broad street, with other tracks of said company now in Mulberry street, in the city of Newark; and. Whereas. Said extension is not more than one-half mile in length: now, therefore. Be it ordained by the Board of Street and Water Commissioners of the city of Newark, as follows: Section 1. That consent and permission bo and the same are hereby granted to Public Sendee Railway Company, its suc cessors or assigns, to locate, construct, op erate and maintain the following extension to its street railway system, being a single track extension from tracks no\t- constructed and being operated in Broad street, over I^fayette street, to and connecting with tracks now constructed arid being operated in Mulberry street. Permission is further granted to said company to operate cars over said track bv electricity supplied to electric motors on the cars from overhead wires by what is known as the overhead trolley sys tem and to erect the necessary wires there for and for the purpose of supporting said wires to erect and maintain nineteen (19) poles in the locations indicated by the num bered yellow dots on map numbered 11.223-L, above referred to. Said poles are to be specifically located as follows: Pole No. 1 is to be located within the northerly curb line of Lsfayetto street on the easterly side line of Broad street, pro duced. The rails composing such track ore to be laid on each side and equally dis tant from the centre line above described and are to be of a gauge of four feet eight and one-half inches (4 feet 8H inches). Section 6. The company shall maintain and keep in repair the pavement and cross walks between its tracks and eighteen inch** (18 inches) outside thereof. Section 6. Nothing In this ordinance shall be construed as a waiver by the city or any right that it may have under anv ex isting ordinance or ordinances respecting street railways or the use of the public streets of the city of Newark by street fa il ways. Section 7. The cost of advertising in con nection with this ordinance shall be paid by the said Public Service Railway Com pany. , .. Section 8. The period for which said permission is given is fifty (60) years from the date of the passage of this ordinance. Section 9. This ordinance shall take ef fect immediately but shall not become op erative unless accepted by said Public Ser vice Railway Company, by the filing with the clerk of the Board of Street and Water Commissioners of the City of Newark of a Urinal acceptance thereof, in writing, exe cuted by the duly authorized officers of said Public Service Railway Company, within twenty (20) days after notice of the ap proval of this ordinance, otherwise this ordinance and the consent and permission given thereby shall be void and of no ef fect.
