Petitions of Fred Notli it Co., and Joseph Bnder IU relation to their taxes lor tbe year 1885 presented, read and referred to committee on finance and taxation. Alderman English moved that ths city clerk be instructed to procure anew seal for the city and a blank ordinance book. Carried. The following commnuicntion was re ceived from ojity attorney, Hon. Wm. P. Dewey, and read: To the Chairman of the Committee on Finance of the Coancil: Yoa have asked for my opinion on two subjeots, namely: 1. Has the mayor and connoil the power to remit taxes 2. Mast a party residing within the city and doing business therein and having personal properly both within and without the oity, pay oity taxes up on all his personal property, or dues personal property stand liable to pay personal taxes only in the locality where situated at the time it was aosessed? I reply that theoharterandordiuanoes of tbe city, npon revenue and taxation are not full and explioit upon those sub' jeotfl, and J, therefore, resolve them an they are, ond both interrogations may bo answered at one and the same time. The oity has no oomplete and indepen dent assessing system. The completed oounty assessment fur. [See subdivision X, chapter 13, of tbe charter.] The next, subdivision 81, of the same section of the charter provides: "The mayor and council shall have power to aot as a board of equalization for tbe city, to equalize assessments, and to cor r«ct any error in the listing or valuation of property, and to supply any omis sijns in the same and to make a general lucrease in the valuation of real estate, not exceeding fifty per oent, as in their judgment they may deem proper." [Hoe also section 2, of chapter VIII of the re vised ordinances.] "Sec. 2.. The mayor and oounoil shall, as aboard of equalization, bold a session of at least two days, commencing on the third Monday in August annually, at 10 o'alook a. m. and contiuning nutil o'clock p. m. each day while iu session uud shall continue from day to day, long as they may deem neoessary lor the purpose of correcting the assessment roll of the oity, and during the sitting of said board uoy person feeling aggrievedgjgfby anything iu tbe assessment roll may apply to the board for the corrootiou of any •apposed error in tho listiug or valua uii of the pruferiy therein ensmerated or omitted, either real or personal." Then, upon the conclusion of the equalization by the mayor and ooancil as provided by the charter and ordin ance, the assessment roll for the current year is oomplete and the tax levy ih made thereon. From this time on, the mayor und oounoil have no power whatever over said assessment roil, so far as altering the same, and they can no more ahangt the roll tnan tbe humblest citizen in the city. All persons liable to pay taxes in the oity are bound to take notice of the as soBsment roll and the meeting of tht board ot equalization to correct and pei feet said roll, and if any person fails to attend the meetings of the board, they do so at their peril,and the completion oi tbe roll by the equalization tbereot, be comes in the nature of a final judgment, against whioh there is no appeal, exoept only that if the property luted is exempt lrom taxation the tax levied thereon canilot be oolleoted. The board of equalization mast keep reoord of its proceedings and aotion so that all ohanges In the original roll as taken from the oounty assessment, may be shown and explained, in case any question is raised as to the regular ity and validity of the assessment, upon which any and every item of tax levied. Suppose for instance, after the assess ment roll is completed, by the equaliza. tion thereof, as provided by law* one citizen claims of the mayor and oounon that his valuation is too high so oan also another citizen olaim the Bame state of things, and, if this were permit ted and tolerated, the mayor ana coun oil might be under the the necessity of reviewing the whole roll, and there no law authorizing or warranting suoh a proceeding on the part of the mayor and oounoil. The law provides a oourt of error, in the equalization of the assessment roll and he who fails to attend that oourt, does so at his peril, and is thereby fore closed of his remedy, and the mayor and oounoil, aa I have said before are estop ped from any farther chang in of a roll, and I am unable to find any law granting to the mayor and .oounoil any authority to remit taxes, or to inorease or lessen the assessment of any indivi dual. It is tbe province of the taxing laws to require eaoh individual to pay taxes equally npon a valuation of his personal and real property. The law points out the way of arriving at that valuation, and in no way other than as the law provides, oan that valuation be deter mined. Taxing laws oannot too striotly be fol lowed. Tax liens are oroated only by law, and the law mast be striotly follow ed in order to create valid tax Jiens and there mast be by dear reoord evidenot showing the laws in all things to have been followed and complied with, in oi der to sustain snoh liens in the ooarts. Carried. The following report of Chief Engineer of the Fire Department Fred Kiucal was received, read and ordered filed: Fire Department, Oity of YanktoD, D. T., Office of the Chief JBngiueer, Yankton, Jan. 6, 1886—To the Hon. Mayor and Council of the City of Yank ton, D. T.,—Gentlemen: I bave the honor herewith to submit to you my an nual report, of tbeaotions of my depart ment for tbe year ending December 31st, 1885, and suggest to yon the wauts ol the department. There have been five alarms of fire to which tbe department responded as fol lows: First. On January 11th, at 5:15 a. m.,on corner of Third and Walnut streets, in Morrow's old photograph gallery build ing. Was burned bat all adjacent prop erty saved. Second. April 1st, at 5 a. m, small stable on alley between Second and Third streets, Docglas avenne and Capi tol streets, rear of Banker's residence. Fire was confined to said stable. Third. May 10th, at 10:45 p. m, Pressed Brick oompany's yard, loss small Fourth. Oot. 27th, at 4 30 a. small stable on alley corner 4th street between Broadway and Cedar. Stable consumed but fire kept from spreading. Fifth. Dec. lOtb, at 4 p. m., dwelling house of F. F. English, on 6th btreet, be tween Mulberry and Pearl streets bonne und contents savod and damage to build in small. I bave at this time three oompanies in my department, as follows: Teller hose company No. 1, thirteen members. Champion hose oompany Mo. 2, fifteen members. Hook and ladder oompany No. 1, nineteen members. Total Biun ia department forty-seven in all. I deem it extremely neoesBary that you famish my department with five hun dred feet more of hose to be used as Bnp ply. The two hose carts carry all the nose we now have on their carts, not leaving us one foot extra for supply and under the present system of drying hose it takes a considerable time to dry some and nhonld two fires occur during the cold months within twenty-foar hours of one another we would he unable to succes tully contend against the second fire, the reason of asoaroity of hose. I also deem it necessury that you sap ply the department with a closet prop, erly fitted up in which the uniforms of the different companies may be kept This is extremely necessary as the com panies are put to a great inconvenience at times in the present manner of keep mg uniforms wherein each man keeps his own uniform to himself and in some oases they have been kept most effect ually as has been proven by some per sons leaving town and their uniform* have left with them—as witness the oase of Teller Hose Co. No 1 and Champion hose Co. who have lost several of their uniforms in that mauner. 1 band yon herewith reports of the different fire oompanies, also constitu ting of the department adopted Dec. 21st, 1885, for your approval, Examined all hydrants and found them in good worsing order, Yours Respectfully, FBED KINCEII, Chief Engineer Fire Department. Alderman Files moved that the execn tivo committee be instraoted to ascer tain the cost of 50(tfeet of lire hose and report at the next meeting of the coun oil. Carried. Section ten of article e?ght f8), of the revised ordinance of the City of ankton is hereby amended so a* to iead as follows: On the firat Monday in January next suewted lug the levy of any annual city tux including the 10 for the year 1885, the same if unpaid shall become a: be deemeu delinquent, and shall be charged with a penalty ofhve (5) per oent interest at the late of one per cent per month from the date of such delinquency. If any tax on any real estate in said city, together with the penalty and interest due thereon, is not paiu before the first day of May next after the *amo hae become delinquent, the treasurer shall proceed to collect the same, together with costs of sale by public sale of such real estate.
