Tho Sioux Palls Press shows itself to be open to radical oonviction by the facility with which it discusses pending propositions and tbe soul felt eagerness with which it seeks information from the columns of the Press and Dakotaian. With a few placid remarks we havo calmed the fears of tho Press that tho Press and Dakotiuan might bo' switching its trait^ off "tho statehood traok, and now it wants to know— But as the territorial legislature and tbe court live, move and have their be ing frum the same souroe how can the legislature pass a death sentence upon the courts? As for the territorial laws, what would there be left if they were abolishad? Besides the constitution declares that the laws cf tbe territory shall become the laws of the state. The legislature of Dakota Lias full power to change the boundaries of judi cial districts, to plaoe the various judges wherever it m»y choose and to fix times and places for holding oourt. (Sse sections 3, 4,5,1918 and 1919 of the or ganic'aot, edition of 1885.) Under these thess provisions it would be entirely practicable for the ter ritorial legislature to create enough distriots for tbe territorial judges in the north half of Dakota aud to aesigu them to places outside the boun daries of the proposed state of Dakota, leaving a dear field to our state judges and thus avoiding any coniliot between tho government and the state judicial authorities. In answer to the second proposition of the Sioux Falls Prces: There would be left after the abolishment of Uie ter ritorial laws—the state laws, to be created in advance by the state legislature, al ready an organized body, and now pro vided for by tbe state constitution. The aot of abolishment by the territorial legislature would bo merely an aot recognizing and coinciding with a Btate constitutional provision and would give momentum to that provision. Seotlon 1851 of the organic act says: Tbe legislative power of every terri tory shall extend to all rightful subjects of legislation not incontistent with tbe constitutiou and laws of tho United States. Tbe legislative body has] power to enact, repeal or abolish and it bas demonstrated in hundreds of instances that it also possesses the power to apply such enaotments, repeals or abolish ments to any portion or section of tbe territory, and to stay tbe effect thereof in other portions and seotions. Oar belief is that a solid Bouthern legislative delegation committed to action as above outlined should be eleoted, and if it becomes neoessary for them to go to Bismarck next winter they can there exeroise their own judg ment as to the advisability of deolarmg themselves and their section indepen dent of territorial allegiance, being gov erned by existing conditions. The remarkable strike among the laboring men of the knights of labor in the employ of the Gould southwestern railroad system is approaching a period where its existence will not be tempered by the wisdom wbioh has thus far made it eminently respectable. The railroad combination^ gathering its forces for re sistance and the first overt aot in its own behalf has produced a rosponsive act of violence npon the part of the knighte. They have demonstrated by that act an intention to resist through force the em ployment of other men to occnpy their forfeited places, and the moment this phase of the conflict is fully developed they become subjeats for an exer oise of the full coercive power of munici pal, state and general government. Up to yesterday their oonduot was of the sort whioh invoked the applause of the world. They entered upon an effort to right their wrongs in a quiet, law abid ing, dignified manner, exhibiting full respect for their employer and a desire to proteot tbe state againBt acts of law lessness. This gave to their movement a grandeur which enlisted popular sym pathy. But the overt act of yesterday at Fort Worth gave promise of a return to the mob code of the past and if fol lowed up will weaken the cause of the knights. Senator Moody is at his home in ifc&d wood and the Pioneer finds in him a confidence that the report of tbe house committee on territories on tbe Harrison bill will be of such a character that it will be acceptable to tbe friends of the statehood movement. The Pioneer, on the authority of Senator Moody, says: Perhaps tbe bill as it came from the senate, with oertaiu amendments look ing to another vote of the people of south Dakota upon the constitution, and submitting the question of division up on the forty-sixth parallel to tbe people of tbe whole territory, will be reported. Perhaps the Committee will agree upon an enabling aot for south Dakota. But unless there shall be a radical change the sentiment of that committee as ex pressed by tbe members, their report will be favorable, and suoh as the friends of south Dakota' will accept. In tuch case the bill will go throagh tbe bouse without much opposition. In tbe event that the majority of the com mittee do not agree to suoh a report as tbe friends of south Dakota oan accept, the minority of tbe committee will reoommend the passage Of the senate bill without amendment. Enough demoorats in tbe house have pledged their support to that measure, with the republicans to pass the bill, unless tho" democrats shall caucus against it, which is not likely, as many of tbe leaders among them are out spoken in their opinion that the party cannot afford to oppose Dakota's ad mission. As we suspected it would, time has brought about an explanation of the al leged anti-Dakotaian utterances of Marshal! Maratta, so muoh commented upon by indignant newspapers. Tho explanation that Marshal Maratta never said it is sufficient. He has ever been loyal to the riaht side in Dakota matters, regardless of politics, and has thus in curred the enmity of "the gang" who ol ways stand ready to injure him by open or covert nttaoks. This road was constructed by a St. Paul syndicate, it was supposed in the interest of the Book Island company. T. P. Murphy, of Sioux Oity, has been confirmed as United States attorney for the northern district of Iowa.
