Reduction in tho numb of dishonorable discharges from the army and a grading down in the severity of courts martial sen tences a-ro expected by the Judge Ad vocate General's Department to re sult fVom an executive order limiting military peace time punishment which gies into effect tomorrow. The order follows wido agitation over court mnj-tial penalties during the war pe riod. A memorandum from the President attached to the order directs that maximom punishment and dishonor able discharges be imposed only in aggravated cases. This is expected i have more effect in reducing pen alties, it was stated than the actual order, which reduces punishments tov 21 different offenses under the mil itary code. The old maximum of ,18 months' confinement for desertion by men lees ttuin one year in service hits been re duced to one year, and in casess of moro titan six months- service, from 2 12 to two years. The period of ab sence for which desertion penalty's WHY, TAKING can be imposed is increased from 30 to 60 days. Th maximum penalty for fraud- I ulent enlistment has been reduced ! from one year's imprisonment to six ! months. The greatest reduction of maximum confinement is fer assault without deadly weapons, which was five years, reduced to one year. The maximum where weapons are used still i3 five years. The maximum for obtaining under falso pretenses money or property valued at $50 or more is reduced from five years to three years. "The executive order will not re sult in a radical reduction erf penal ties," Colonel C. A. Kreger, Acting Judge fdvooate. declared. "Punish ments for offenses in the army have been based since 1914 on a consensus of those fixed by different state laws for similar civil offenses. The execu tive order reduces maximum penal ties for such offenses as fradulent en listment, desertion and other pecu liarly military in nature, but maxi mum penalties seldom have been awarded for these offenses. "Tho President's memorandum calling attention to thie Articles of War which pro-vide for n. grading down from maximum penalties where cases are not aggravated -probably will have more effect in lightening punishments than tho reductions which he actually orders. His mem orandum, however, but stresses what is already a part of military law." Since 1S90 the president has been authorized by Congress to fix the limit of military punishment by exec utive order, and several such orders have been issued from time to time by different presidents.
