It is now in order for some unfortunate to declare that -in this view of the case, the distinction exists without tbe difference except that one method Is slower than the otber. In the Michigan state convention Dan J. Campau came out in triumph as the confirmed democratic leader of the state a position be wrested from Don M. Dickinson five years ago. Campau is the national committee man and was chosen as the first dele-gate-at-large to the national conven tion. I he Campaus are a historical family in Detroit. Dan's great great ancestor came from France 'way back about 1690 and settled where Detroit now is. In those days the magnificent Detroit river was valuable and as the country was settled the farms were laid oat like shoe strings with a front age of a few hundred feet on the river and running back about four miles. The title of the farm clings to them still, although there is now a city of 300.00 J Inhabitants. Dn Campau lives on lot 1, block 6. of the original Campau farm. He is immensely rich, young, handsome, and educated for the law. He owns the Campau block. which is one of the handsomest office buildings in Detroit. Constitution Extend. One federal judge has already ruled tbat all island territory acouirea by this country through the treaty of Fans must be governed bv the United States under the constitution. and under no other terms. This view of the case is taken bv United States District Jndge Locbren at St. Paul The decision was given in the case of Raphael Oritz. a Porto Rican, who is seeking release from the state prison at Stillwater on tbe ground that bis trial for murder by a military court was unlawful, because as an Ameri can citizen he was entitled to a trial bv iurv. His application for a writ of habeas corpus is denied, however. on tbe ground that the island was in a state of war before the ratification of the treaty, when the murder was committed, and tbat therefore the military court had lurisdiction. As sistant United States District Attor ney Purdy argued against the appli cation yesterday. He maintained tbat in any event the constitution of the United States did not extend to the island until the exchange of rati fications on the treaty of peace by the two governments, and that while there was no fighting between tbe date of tbe signing of the treaty and its ratification, still tbe island was in a state of war, and therefore military trial for crime was legal. In an oral order from tbe bench at the conclusion of the argument Judge Loch re n sustained this view of the case. He considered tbe question raised verv important. After review ing tbe facts in the case and noting that the trial took place between tbe date ef signing tbe treaty of peace and tbe exchange of ratifications, tbe court said that according to the de cisions of the supreme court of the United States a military commission was without jurisdiction to . try a civilian in United States territory in time of peace. He considered Porto Rico territory of the United States and subject to the constitution the minute it came under the control of this government Unless tbe constitution extended to Porto Rico in advance of action by congress, congress would have no power to legislate for the island at all. because it has no authority to legis late for any except territory to which the constitution has extended. He called attention to a number of deci sions of the supreme court and the opinions of eminent jurists on this point. But the constitution did not extend to the inhabitants until after the ratification of the treaty. The real question in the case, he said, was whether Porto Rico was in a state of war during the pe riod between tbe signing and ratifica tion of tbe treaty. Although there was no actual nzbtinsr. the military had control, and in the event of fail ure to ratify, the war would have been resumed at once. Therefore a state of war prevailed. There was a cessa tion of hostilities pending an effort to restore peace, but peace was not re stored until the treaty had been fully ratified by both governments. In the interim the only form of trial that could be bad for crime was military trial, and for tbat reason he consul ered the commitment of Oritz regu lar and denied the writ. Judge Willis took an exception to the ruling that the island was in a state of war between the signing and the ratifying of the treaty, and also to the ruling tbat tbe constitution did not extend to the inhabitants during tbat period. ritz was convicted and sentenced to death by a military court. His sentence was commuted to life im prisonment. His attorney claimed that his trial and conviction were a violation of his rights under the American constitution in that he was tried by a military court rather than by a civil court and jury. M. D. Purdy. arguing on behalf of the United States, maintained tbat tbe proceedings of tbe military commis sion which triedand condemned Oritz were regular under the law; tbat the provisions of the constitution of the nited States did not extend to Porto Rico immediately upon the signing of the treaty of peace between Spain ana the United States, but awaited tbe ratification of the treaty by the United states congress and bpamsh cortes. ana tnat meantime the island was properly governed by tbe military arm of tbe United States. The decision of Judge Loch re n tends to establish the course pur sued bv congress at the behest of President McKinley in opposition to our "plain duty" as unconstitutional as well as morally an outrageous form of discrimination against a trusting people. It is safe to presume that there will be no more federal court de cisions on this question between now and election if Mark Hanna can ore vent.
