Jus tice Henry Ditzen has rendered a deci sion in the case of the Union Electric Telephone company vs. Dr. J. E. Ben nett, in which the Telephone company sued for $14 for seven months' service and in which Dr. Bennett filed a coun ter claim on the ground that he was delayed from his business by being given a wrong number to his phone and also resisted the payment of the bill on the further contention that para graph six of the telephone company's contract was contrary to public policy and therefore the entire contract was null and void. Justice Ditzen in his decision, states that no breach of con tract has been shown by Dr. Bennett and that therefore the court is not calkd upon to determine whtther or not paragraph ; is contrary to pub lic policy or not. Justice Ditzen fur ther refuses to allow the counter-claim of Dr. Bennett and finds him liable for $14 for seven month's service of the telephone installed at his place of bus iness. Dr. Bennett still shows fight, hov. ter. and has taken an appeal to the district court. Bank in New Quarters. This morn ing the patrons of the Security Sav ings bank found that institution locat td in their handsome new home on the ground floor of the building recently purchased by iheiu at the southwest corner of Second and Harrison streets for a consideration of $35.'im). In the midst of the troubles that confronted the men of the chinch on the frontier, Dan Sully appeared last night at the Illinois as Father Daly in Boom City, Idaho. The first scene is typical of the small west ern town with the eosmojiolitan popu lation, most of the business of the vil lage being done at "Tom's Place." Sul ly's part in this play, "Our Pastor," is one full of natural situations and for that reason there is a variety and fre quent change from the sublime to the ridiculous. Through all of these he plays the part of the Irish Catholic priest, the character full of wit and wisdom, afraid of nothing ami ruler over all. "An Orphan's Prayer."
