SOCK ISX.AJTD ZXtXiXXrOZS, Friday, March 9. 1377 EVERYTHING ALIUNDE, WITH THE REPUBLICANS. Remarks of Hon. S. S. Cox, in the U. S. Hotxi of Representatives, in Rela tion to the Electoral Com mission. Mr. Cox. Mr. Speaker, after many yeara of active service as a member of this house, recalling all the vicissitudes of our politics for twenty years, I cannot feel responsible to day that after the verdict of the American people it should prove a fruitless verdict In 1864, on the 16th of May, I presented a resolution to this house which passed. It i elated to the regularity and authenticity of tho returns of electoral votes and for a law to provide for the juris diction as well as the course of proceeding in case of a "real controversy." The ju diciary committee took no action at that time. Allow me to quote the resolution. It is a compend of the situation: ?ftnp(i, Tht the Judiciary committee be direct ed to take Into consideration the propriety of reporting s bill providing (or the decision ot any questions which may arise as to the regularity and authenticity of the returns of the electoral vote for president and vice president of the United States, or the right of the persons who save the voles, or the manner In which they ought to be counted; and that such law provide for the juris diction, aa well as tbe course of proceeding, in a case of real eoutrovcry. Peril fives the lessons of years in a day, Unless danger is followed by diseased and gloomy misfortune, its lessons are medi cine and its teaching light. All the reme dies for human ills do not come from political society; nor do all tbe splendors of the heavens cure the remediless. Hope buoyed up the soul of a great people dur ing fifteen years of wrong. It still sus tained them after fraud had tainted and pestilent wrens had shrouded the verdict of an uprisen people. Hope itself almost perished in view of the events since the election, and especially those which this congress has witnessed. The people of the United States, desir ing unity and peace, honesty and rejuven escence, spoke in all legal forms provided by a complicated system of electors in fa vor of a party whose traditions, .prin ciples, and history of honorable service have rendered it deathless, and against a new party ot expedients and pretensions. It was unmistakably called to the high places of the land. It matters not who were its select exponents or can didates; and it matters not now what were its shibboleths and platforms. Whether wise or not, far sighted or not, just to all races and sections or not, prudent in economy, provident in matters of tax and JUc or not, organic and faithful to the rules of constiuction applied under the gen ius of our peculiar polity or not, the un questioned popular majority of three hundred thousand pronounced for relief and change, and for the Democracy as the directing organ of that relief and change. By the system of state and federal au thority this federal change and relief was to be certified by certain state organisms and veiified by a certain procedure under our federal constitution. It was early made clear by certain man euvcrs and devices of politicians that the voice of the people of two if not three btutcs was to be muffled, or rather that a false voice was to be heard in the land proclaiming that which was not for that which was, It was the siren voice of Duesf a and nut the blessed voice of Una. It was a voice which sounded high for state rights like that of the actor through the Grecian mask, hollow and tnockiog, while at the same time it seemed to pra ceed from some hero or demigod raised to unusual height by the tricks of the stage. Nor, sir, do I feel responsible for the steps which were wisely perhaps, or un wisely, but certainly with a view to pru dence, taken in framing the electoral bill, That bill is the law. We know what it is. what its provisions aro. I knew and felt that some virtue had gone out of the house when we had passed it, but I did not exactly see where the virtue had alighted. ILaughtcr, I knew the old privileges of the commons had departed.but in the interest ot peace I gave a reluctant vote for tho bill. It was voted in a spirit of confidence and in a moment of peril, and under terror ot force and revolution which speaks more for the caution than for the pluck of our people. Still it was voted. We are bound by its decisions, but not by its reasons J he laith ot those who voted it was strong in the integrity and purity ot their case; and next in the fidelity and independence of tho tribunul. e placed our faith in the ermine. Tho little animal which wears its fur and is too dainty to be soiled, and would rather be caught and killed than to be bedraggled in the mire, has at last Inst its reputation, and becomes one in the future with the returning board of partisan politics. But one strange thing about the bill is this: that while wc are permitted to vote in this house, yet after all it is a sort of 2t mortem vote. Laughter. ! Although we aro permitted to argue, it is a arqu vvntum ad post factum- Although, sir. there is some utility in the dissection of tho dead and although there may be some thin? gained bv the dissection of the liv ing, laughter,! yet it seems to me to be proper now to lock at oue particular clause of the law before 1 state my reasons for making protest against this measure. We are graciously permitted under this bill to argue after the matter is accom plished, and although we vote and although wo carry our vote in the house we are "gone." ILaughtcr. We gain nothing. We are permitted to talk ten minutes after the counting and the conclusion. And what is it we try ? Why, tir, every thing as to testimony and facts, and for gery and perjury, and force is aliunde outside not to be considered. Truth and justice and morality and fair dealing aliunde. Tho house is aliunde. Laugh ter. All its acts and the acts of its com mittees and their reports, all the facts gathered in these southern states aliunde! Laughter. J Nothing to be considered but the bare, naked iact of a certificate, based upon what? Ou torgery and chicanery. Mr. Speaker, some member over there said he was sick of fraud, of the cry of fraud. Earth is sick and heaven is weary of the hollow words which states men and judges use when they talk of right and justice when such things can be accomplished. I tell you, Mr. Speaker, by human law there is no statute of limita tions to protect fraud. It never runs for fraud. In divine law it is written, "There is no rest for the wicked." ILaughter. Every avenue of societv. Everv relation of trust which permeates shah at last be investigated and made null. Crime cannot breed crime forever; strength shall not al ways aid the strong. The time will come. if not now, in some near future, when gen tlemen on the other side, who now laugh and taunt because of this condition in which the Democrats are caught, will re pent of this great crime of history of which they are particeps criminis. Time never runs to condone fraud, and in all God's universe there is to be cease less unrest for its vicious votaries. Quib bles from lawyers, technicalities from judges, special snapperadoes from the in tellect are as grass before the mower where fraud taints and blackens. The peop'e) cannot understand why it should be protected. Chop logic and split hairs to the nicest division of logomachy, call in the schoolmen, make your legal syllogism and refine your sub tleties, the everlasting rule remains that where fraud is found nullity and void fol low. Foxes by no doubling or hunting, by no cunning and craft can confound the fact that fraud is the most offensive element in human society, and most to be feared when the fox takes the form of the ermine. Ah! they called in the ermine to help them. The ermine is a little animal. It is aa emblem of purity; it would rather be caught than be bedraggled in the mire. Hunters put mud around its haunt to oatch it. But wherd is the ermine now? Ah! the fox has become the ermine. But no cunning, no craft, no human law, no divine law can ever condone fraud. All nodes and the histories ot all nations cry out against it. Crime cannot breed crime forever.
