The New Mexico supreme court, which conren ed in special session here yesterday, handed down the following opinlcns In cases pending before It on appeal: Case No. 1233, affirmed. United States, appellee, vs. M. E. Cook, who was convicted of adultery, In the Firth judicial district court The opinion is by Chief Justice Mills. Case No. 1232, affirmed. Frank H. Jones, trustee in bankruptcy ol the Oro Dredring Company, a bankrupt, vs. Charles Springer, appellee. The Bult was brought to set aside th j sale hy order of the court of . the Oro Dredge, at Moreno, Colfax county, to Charles Springer, for $5,000. The supreme court holds with the d'strict court for Colfax county, that the sale was a bona fide one and valid. The opinion Is by Associate Justice Mann, who wrota the following syllabus: 1. A purchaser of property Bold un der. Section 2716, Compiled Laws who was a bora fide purchaser for value, without notice, hat. a perfect title to the property. 2. 'Where a state pr territorial court sells attached property, as per ishable or liable to be lost or dimin ished in value during the pendency of bankruptcy proceedings against the attachment creditor, of which neither the court, the officer making th sale, or the purchaser had any notice until after the sale was confirmed, . the trustee in bankruptcy must take the proceeds of such sale In lieu of the property po sold. . 3. A bcna fide purchaser for value at such sale Is tpeclflcally protected by the proviso following section 67 of the bankruptcy cctof 1898 (30 Stat. L. 565.) No. 1238, reversed and reminded. Opinion bjr Judge John R. McFie. T. A. Fabro, appellee, vs. town of Gal lup, appellant, appeal from McKinley county. The suit was brought to re strain the town of Gallup from Issu ing water bonds to the amount of $20,000 voted at a special election at which 52 vot&a were cast, 11 of these against the bond Issue, the plaintiff maintaining that two-thirds ot the entire vote of the town should have Teen cast to make the Issue a legal 'one. The district court took this view of the ca3e, but the supreme court does not. (- No. 120a, reversed and remanded. Richard De Palma and Bernard Ruppe, appellees, vs. J. A. Weinman and Joseph, Barnett, appellants in which the plaintiffs who had sued for $20,000 damages caused to them by the collapse of mi adobe wall which ruined the drug store of Bernard 'Ruppe at Albuquerque, had been awarded $4,000. The opinion is by Judge Mann. No. 1259, reversed. From Chaves county. W. L. Sears, appellee, vs. .John Fewson, appellant, Involving the validity of the socalled Lincoln coun ty fence law of 1884. The opin'on is ty Judge Abbott, the lower court had grar.ted a decree perpetually anjoin lng the defendant from permitting his cattle to wander and trespass on the said crop and grasses - of the plain tiff. Curran, defendant, the latter having fal'ed to perfect ap peal, the judgment of the court below for $573.08 was affirmed and judg ment and ten per cent damages, 'or dered, tho sureties being Thomas J. Curren, M. P. Stamm and A. M. Whit comb. No. 1202, Elgin Douthitt by his next friend, Thomas J. Douthitt, vs J. B. Bailey, judgment was modified bo as to include Judgment against the sure ties. Examining Committee Appointed. The court appointed Charles C, Catron of Santa Fe, secretary of the New Mexico Bar association, W. J. Lucas Of Lai Vegas, and Julius Staab of Albuquerque, as a permanent exam- infng comfilittee cf applicant for the bar, under the tew bar examination law. Cooley Takes Place on Bench Judge A. W. Cooley took his place on the bench, succeeding juag Ed ward A. Mann. While the retirement of Judge Mann Is greatly regretted, it is also acknowledged that In Judge Cooley tin court has maaei a welcome acquisition of a learned, up right and conscientious Jurist Judge Cooley took the oath before Territorial Secretary Nathan Jaffa and filed Ms oommisson with Supreme Court Clerk Jose D. Sena. REGISTERS KICK AGAINST SIREN A citizen has addressed, a communi cation to The Optic, registering a vigorous kick against the elren whistle, used as a fire alarm. The kick is by no means untimely, and should bo heeded. The communica tion reads: Mr. Editor: la Las Vegas there are very few things of which to com plain with Just cause; the people are most pleasant, the climate ia not to be excelled, tho mountain water Is of the very best and life in tho Mea dow city Is generally conceded to be very agreeable; but there Is one thing which could either be regulated or dispensed with entirely and which has been considered a public nuisance in other cities mf this size; this is the horrible whistle at the power house used as a fire alarm. To persona who are 'sick or Indis posed or even nervous the awful noise with the tidings It bears, some body's house afire, ia enough to cause them to think of their prayers and fear they will not be ready to respond to the laet call which is apparently at the ,next corner and headed this way; we do not know Just how Gab riel's trumpet sounds, but hope It Is not like at siren whistle. M.. July 2. Dur ing the storm the other night, light ning struck a house at San Geronimo, owned by Felix S. EsquibeL The dwelling was set on fire and burned to the ground together with its con tents. Fortunately the occupants es caped with their lives. Sneak Thieves Busy During S. L. Fisher's absence some entered his house and absorbed all his loose cash and a certificate of witness fees. Colt Falls Down Mountain Rodger Palmer was driving some horses over the mountain, passes, when a two-year-old colt got funnj fihd lost its footing. It rolled, tumil-' $d and landed some two hundred feet below fa the forks of a tree on its back with its feet sticking straight up. PIONEER NEW MEXICO x WOMAN DIES AT RATON Raton, N. M., July 2. Mrs. A. J. Young, on of the pioneer women of Colorado and New Mexico and the mother ol J. C. Mandy of Trinidad, Oolo.. died here after an extended ill nesa of three years. The decease i was 75 years of age and came to this section in 1873 and settled on the place now called VermJo ranch, which Is a;, present owned by WUllam H. Bartlett, the partner ol Janliis H.
