Clancy has down the following opinion on the question or taxing armories that are hired for private dances, but from which tha rental is used for' public purposes: Albuquerque, N. M.. Nov. 24. 1909. Major S.' A. Mlliken. Secretarv. Sil ver City Armory Boar of of Control, Silver Clty,N. M. . Dear Sir: I have to acknowledge receipt of your letter of the 20th ou "7 la ?dr to meet the expenses of fur- "fS- etc., the v-uunui oi toe auver. uity ' - l" V u" I0J Jf fo'm PP amusement for ltT fZ! lt ,has been notified that ..,..4 uwll uv u.iv n cu w uu BVF CACUL upon taking out a license and paying a special tax for a place of amuse- meni. i note also tne fact that you further say in the letter, . that all funds obtained from the use of the Armory building are applied to the expense of its equipment and main- fpno.no ienBnce - I aSSU assume that the license and spec ial tax required must be under , the requirement of section 4146 of the , , fcTv I a . . , Z the property under Its charge, are not subject to any such tax under the circumstances and : conditions stated in your letter. As a general rule property of the government Is not subject to taxation even when there is no statute , exempting It, but there is a specific statue in this ter rltory, so much of which needs to' be considered In this connection Is as follows: The following property, and no oth er, shall be exempt from taxation Property of the United States and of the territory, counties, cities - and towns and other munclclpal corpora- tions, when devoted entirely to pub- lie use and not held for pecuniary profit. Where all funds obtained from the use of the armory are applied to pub lic purposes connected therewith, I believe that it cannot be said, in any proper sense of the term, that, the armory is neia ior pecuniary pro- t '1 nave Known oi caB mexiuo wueio wuuW - have rented tne couri nouse ior nutu purposes, the proceeds going into the county treasury, and I have never heard it suggested that therefore, the county ought to pay a tax. The ter ritory is the owner of large quanti- ties of Iand donated by Congress, a great deal of which is leased, and the are held for pecuniary profit quitf as mucli" as your armory, if used as stated in your letter, and yet the sug- gestjon tnat sucn lanas . snouia , ue taxed would not find any support from any one. me uoaru oi vwuui m iu. armory is a mere agency of the terri torial governmeni ana cannot ue ouu- jected to taxation any more than the territory, itself. V It. .Is to.be admitted that in some Jurisdictions In .the ., United; ( States, there may be found decisions of the courts not entirely In harmony with my opinion but so far as they are well-founded I . believe that Investi gation wfll show that they are based upon lodtV constitutional provisions unlike f any which , ' are in force in New Mexico. If the armory should be t used for the purpose of gain, which would not be applied to the legitimate expenses of the board of control, a different question would be presented. If, for Instance, the board of control should undertake to lease the building to any person for use as a place of amusement, so . that , the party would hold it as a means of pe cuniary profit to himself, by attempt ing to make more out of its use than he would have to pay to the board of control, then that person might be subject to the occupation tax prescrib ed in the Compiled Laws. .
