That September 21, 1908, was fixed as a day for hearing said petition, but same was continued at the request of the depositor's association of Sutter Creek State Hunk, and said petition is now pending In this oourt and undisposed of. That on the 28th day of September, 1908. petitioner tiled a petition to authorize him to sell a portion of tbe real estate belonging to the Sutter Creek State Hunk, and certain per* Ftoiiiil properly connected therewith. That said petition came on regularly for bearing on tbe 10th day of Goto- , ber, 1908, and after bearing, petition er was authorized -to make said sale. That in pursuance of ' said order of sale he caused to be published and posted in tbe ninuiinr and for the time required by law, due and legal notices ot tho time aud place of hold ing said sale. That three bids were received, aud that of the liank of Amador County for tbe sum of 82250, was tbe highest and best bid, and was aooepted subject to confirmation by oourt. That on tbo hearing ot return of sale on the 21st day of November 1908, the bid or said Bank of Amador County was raised, and tbe court then auctioned said property off in open court, and finally accepted the bid of D. E. Madden of 82900. That your petitioner thereupon prepared an order of confirmation of sale, filed a certified oopy thereof in the recorder's otlico of Amador county, and executed and delivered a convey ance thereof to said D. E. Madden. That on tbe 17th day of October, 1908, petitioner presented a petition to this oourt asking for instructions in regard to payment of assessment due on 15000 shares of capital stock of the Ames Manufacturing Co. held by tbe Sutter Creek State bank ai an investment; that after hearing on same on tbe 7th day of November, 1908, tbe oourt ordered and directed petitioner not to pay said assessment. That on the 2d day of November, 190S, after petition and hearing on same, tho oourt ordered and directed your petitioner to pay an assessment of two cents per share on 645 shares of the capital stock of South Eureka Mining Conpany. That on the 21th day of November 1908, after petition therefor and hear ing on sumo, your petitioner obtained au order' of oourt directing him to pay the Amador Reoord, Sutter and Amador Water Company, Amador Ledger and Amador Dispatch tor cur rent bills; that thereupon said bills were duly paid. That on tbe Oth day of. February, 1909, after petition tiled and hearing bad tbereon, petitioner obtained au order of court ooutlruiinq thn sale of 045 shares of the capital stock of the South Eureka Mining Company to John F. lirignole. at ten cents per share net. That petitioner lias devoted Ms entire time to tbe performance of bis duties as such receiver ever since his appointment and qualification on tbe 28th of May 1908; that a large part of tbe funds of said bank were "invest ed" in certain industrial projects in and about tbo town of Niles, Cali fornia; that Jackson Dennis, former president of said bank, wus residing in Uerkeley, Alameda county; that many of tbe people Interested iv suid investments, and owing money to suid bunk were living iv Sou Fran cisco, Niles and other places. i'hut it was therefore, absolutely necessary that petitioner should, iv order to recover anything on said investments, or make collections of uotos, niuku frequent trips to Sau Frunoisco, Niles, and other piaooa, to oont'tti with said Jackson Dennis, and other interested in tbe bank ulfairs. Thnt peittloner is unable to con tinue longer in tbe discharge of tils duties as such reneiver, and tenders his resignation herewith. Thnt petitioner has advanced all sumd of money expended by him for traveling and incidental expenses, and bus received no compensation for bis services as such receiver. That he has needed tbe constant assistance and advice of an attorney, and for that purpose bus employed A. Caminetti, Eaq., of Jacksou, California, who has served ns bis attorney ever sinoe his appointment and qualification. That said attorney has also made- frequent trips to Sau Francisco and elsewhere on business connected with the re ceivership of said Sutter Creek liank; that nothing has been paid his said attorney either on account of expense or attorney fee. Wherefore said Fred Eudey prays that a day be appointed for the hear ing of said account, and that upon said bearing said account be allowed, approved aud settled, and that a rea sonable sum be allowed petitioner and for his services, rendered herein, aud a further sum be allowed him to pay tbe expenses aud charges of his attorney. Hunker Hill.— This mint) paid Its regular monthly dividend of 3 cents per share on tbe 15tb. They are now sinking for a sump of about 70 feet below the level to be opened* on the 1950 foot level. A station will have to be out at this level, which will take about three weeks to finish, after which drifting for tbe ledge at this depth will be pushed ahead. If the ore body continues at this depth in size and quality, which there is every reason to believe it will do, the en largement of the milling oapaoity from '20 to 10 stamps will be in order. Tbe flow of water has increased immensely inoldent to tbe heavy rains. There is about ten times the normal quantity of water to handle. Nevertheless tbe machinery is equal to the task, without involving any stop page of the mill. Defender— lt is reported that owing to the difficulty of securing fuel, this mine near West Point has been compelled to suspend, until spring. It is reported to be looking well as far as tbe ore product is concerned. Zeila.— At this mine tup underg round employes were laid air Tues day morning,'' on account of the im mense flow of water. Argonaut Stockholders' Meeting- Judge Tarn ot Sau Francisco, was in Juckson Monday iv tbe interest of San Francisco stockholders in the Argonaut mine,fund to attend a meet ing ot stockholders called for that evening to elect a board of directors. No action was taken, and the meeting was postoned until Thursday evening following, to onable other large stockholders to be present. A. 11. Carlyie, president of the Argonaut Consolidated Mining Com pany, the holding corporation, wan on bis way from New York, and was expected to reaoh here before Thurs day. We understand he was in Sau Francisco the middle of the week. It is believed that everything will be arranged amicably to all stockholders in regard to the election of a board uf directors. Last evening tbe meeting of stock holders was again postponed, there not beiug a sullicient number of shares represeutod to transact any business.
