The case was tried yesterday in the city court and judgment was given the defendant to recover his costs. It was not the telephone oeonle that Judge Cowell had th0 run in with yeslerday about putting a nole in the sidewalk in Exchange place, but the Western Union people, who don't hesitate to use the streets and sidewalks to make- a home for their poles whenever they want to. The telephone people have so many poles about town and are credited with so many offenses naturally their name comes to one's mind th first thing when he gets his eye on one of these huge timbers and in that way they sometimes get a scoring for things they are not responsible for. But on the other hand a great many of their offenses pass unnoticed so that the kick they get that should have been aimed at somebody else is more than offset by commissions from time to time when they are the real culprits. In any case it is only fair to state ttie rumpus created about poles m the sidewalk in the west side of Exchange place is up to the West ern Union Telegraph company, and it goes without saying that they will come out of the rumpus without los- ng very many feathers, if any at all.
