SATURDAY MORNING, MAY 22 Ucr local column tnit morning contains interesting reading in the hape of abort opinions of practical business men aa to the condition of finance and business and the future outlook for La Vegas. A. BEsBABCH of the annals of San Miguel county under republican mis rule shows that since its organization, but one sheriff (the present incum bent, H. Romero) is not now in ar rears in returns of public money to the county treasury. The inter-state commerce bill, it passed, will benefit New Mexico more than any visible factor. Under its rulings the railronda will be forced to make short hau'sjor the same ratio as long. The fifty cent rate to ter minal points will be a thing of the past unless the companies are willing lo unload merchandise at Las Vegas for twenty-five cents a hundred. Bbarpiteln concurred In the opinion, while Chief Justice Morrison and Justices Roas and Myrjck dissented. Thus It wMJ ' be seen that while the decision 1 final po far as the state of Csilfornls Is concerned is not very strong. Inasmuch s Jr Js only sustained by a vote of four to three, and will not have much affect upon the country at large, until the question is passed upon by the supreme court,' the highest tribunal In the land. Should this body concur in the CalIfornIavppInjBn.J.t III completely unset -the titleDT water rtgbti snd render ibem as worthless as tb$aper upon' which they are recorded. This subject is one, of great importance and has been befara the people for nearly hundred years, and-, though riparian rights were recognised to Sdme extent In the longfago the claim almost became ob solete,: all modera transactions -htvlng been made on the basis that water flowing through land was no part thereof, but was an Independent realty of Itself, and be came the rightful property of Its first sp- proprlator, provided such appropriation was continuous; and water rights tave been bought and sold with the samé coa- fldence that has governed land transac tions. But If the California decision Is sustained the whole basis of water titles Is knocked Into a cocked hat, and the' best water right In the world ' Is not worth Even to the riparian owner it Is of but little value as he can only obtain pos session of It where it enters his land and must return it to its natural channel where it leaves his possessions. But as water la largely consumed by Its diversion from Its proper channel we question if its appro priation for Irrigation purposes, under the riparian hypothesis may not be prevented altogether. This opinion is very unex pected, and is undoubtedly the severest blow western agriculture has ever yet re ceived, and promises to lead to more com plications than any and - all questions with which the husbandman has had to deal. Thi democratic central committee of New Mexico has a very important duty to perform at its first nit cling in selecting a chairman. -The last cam paign proved conclusively that the management of tho same bad been placed in wrong hands, and if the same mistake is mode apain this year it may lose . to the party a victory which is almost assured with a prop erly managed campaign. Tub GaZittb would remind Gov ernor Ross that the democratio party was placed in power because the peo ple believed the republicans thouldbe turned out. There sre some relics of the deposed party still holding office ia the territory, and it there is to be clean democratic administration of affaire here the governor should at once carry out the idea which found expression through the people in his becoming the chief magistrate of New Mexico. All progressive citizens the territory will sustain him' in any lawful action he may take in accom plishing the good work, as they are convinced that be cannot, ham pered and harassed by the remnants of the old gang which still hang on earry out at fully as is ne ess try tb plans be baa formulated for the pro gress and advancement of the terri tory. ' " 1 the taxpayers of San Miguel county desire to secure for the county good, olean, honest, economical ad ministration of affairs, they must combine to overthrow the republican party. . The recent re pot t : of the grand juiy has shown, and'it is patent fact to all who have given the matter attention, that with fewer ccptiooi under the conduct of affairs for a number of yean pat, there has been a reckless di, regard of publio in terests by those having control of the county finances,, ana - the manage ment of oar interests. ' The only way to effect a change is to elect men of character to look after the busi ness, and with the pretent boss sy tern, which marks the management the republican party in this county, a purification of that outfit i-annot b expected, as it would mean the down fall of the bosses, and they stronger than t heir par tv. The question of riparian rights which has long agitated the minds of the farm nrs in countries aere irrigation Is nec essary, has at last been brought to an aue in the supreme court of California, decision being reudored in favor of the riparian owner. The case in point is one of years1 standing. Lux & Miller bad brought suit against the Kern River Land and Canal company to enjoin them from diverting the water of the Kern river, which flowed through their lands, and have at length obtained a decision in their favor. The opinion In the case was writ ten by Justice McKlnitry, 'and embraced over three hundred pages of manuscript It holds that the water flowing through lands Is part of the Realty, a principle which Is based upon the old common law of England, which it maintains is still in force.
