A sufficient contest affidavit having been filed in this office by James T. Underwood, contestant, against Homestead Entry No, 12871, made Nov. 7, 1906, for se4, Sec. ta, Twp. Gn, Range age, by J. E. Kilander, contestee, in which it is alleged under date of December 31, 1907, that the said J. E. Kilander has wholly abandoned said tract, that he has changed his res idence therefrom for more than six months since making said entry, that said tract is not settled upon and cultivated by said party as required by law, and he has never established his residence on said tract, and that the said alleged absence from the said land was not due to his employ ment in the Army, Navy or Marine Corps oi the United States as a private soldier, officer, seaman or marine, during the war with Spain or during any other war in which the United States may be engaged, said parties are hereby notified to appjar, respond and offer evidence touching said allegation at 10 o'clock a. in. on April 10, 1908, before T. 13. S. Denby, U. S. Court Commissioner, at his office in Melrose, N.
