KETCHIKAN, MONDAY DECEMBER 8, 1915.' _ AN UNFORTUNATE SITUATION Under the caption of "SOMETHING TO TALK ABUOT" a short article appeared in last Saturday's issue of the Progressive-Miner, that revealed an un fortunate condition, in that, many may be subjected to lawsuits involving the expenditure of considerable money besides losing their property that was taken in good faith, but apparently held in sufferance. The litigation that must arise to adjust this matter is to be regretted, but under the circumstances, it cannot be avoided unless the holders of the lots willingly and paceably abandon whatever right they may be lieve they have, In the first place, if the land belongs to the town, the council has no right to give it away any more than it would have the right to block a street by allowing an individual to erect an obstruction therein. The council has no right to grant a per petual franchise, because it is giving away property that belongs not only to the present generation, but future generations as wll. The article says that the occupants of lots along that thoroughfare failed to file adverse claims with in the specified time prescribed by law when the town applied for a townsite patent, and therefore, have lost whatecer right they may have had to the lots. It must be admitted that such is the law. If such is the case, it follows that they must abandon the property if ordered by the council, unless they have been in actual and peaceful occupation of the lots ten years since the town received its patent. How ever, it may be that the council may lease the lots to the occupants subject to the will of the people. -+ + + HAVE THEM “PINCHED” A highly estimable and hard working woman came into the office Saturday evening and complain ed of having lost a splendid umbrella. She said that she would like to get the culprit for a minute. When she was asked if she could identify the lost article she replied that she could if the party who took it neglected to remove the handle. Last week, she said she thought she recognized it but on a close inspection she found that the umbrella that she thought was her own, had no handle; and there you have the secret. The fool notion of making umbrellas with remov able handles is causing many to swear like sixty. Every umbrella owner has his private mark and in variably the mark is on the handle. The thief remov es the handle, and there you are, without a mark to identify your property. In that case we advise the losers—there are many—of umbrellas with removable handles, to keep their eyes opened and every person seen with an unbrella without a handle, have him pinched. However, at this time of the year every body must expect to lose one or two umbrellas, and as many pairs of rubbers, an overcoat, a Sunday din ner, etcetc. The only thing that is safe to leave loose around is a woman’s hat, because there are no two alike. -+ + + THE DURABLE RUSSIAN (From the Outlook) I do not care to make a prediction with regard to the future of the Russian army, but I have seen it. fight, at the end of a long campaign, when it had not been cheered or encouraged by a single victory; and my conviction is that it can stand up under re verses as long, and rally from defeat as quickly, as any army that Prussia ever put into the field. If I were a friend of vonHindenburg, Mackensen and the Kaiser, I think I should venture to give them this warning: "Don’t count on smashing the Russian army so that it cannot recover. Like the Libyan wrestler, it draws strength from the ground every time it is thrown. You are now doing your level best, but the Russian army will not reach its maximum effic iency until next summer. Then you, with your waning strength, will have to fight harder than you have yet fought for the territory that you now hold.” -+ + ♦ THE MAJESTY OF THE LAW (From Lesslies Weekly) For collecting five cents under false pretenses, a man forty-six years old was sent to Sing Sing re cently for two and a half years by a county judge in Brooklyn. A respectable boy in Plainfield, N. J., shot and killed a rabbit that was nibbling at the cabbages in his back yard. A game constable ar rested him for “killing out of season.” The lad was dragged from his home, and sentenced to three months in jail. Everybody in the village at once petitioned the Governor for his pardon. It was granted. A stranger called at the door of Senator Goff at Clarksburg, W. Va., with a package bearing Mr. Goff's name. The Senator told the man he had not ordered anything. The stranger insisted that the Senator's name was on the package and that it must be left. When opened it was found to contain whis key. The Senator was arrested for violation of the State prohibition law and was fined. New York has a law forbidding the possession of deadly weapons. A Columbia College professor, while living in the Maine woods, had a revolver for protection. When he was about to return to the city, he directed that the revolver be left in his bungalow until next year, but on unpacking his be longings in New York, he found the revolver. He called in a policeman to take charge of it. The police man at once placed the professor under arrest on a charge of violating the law against possessing deadly weapons and took him before a police magistrate. He was discharged.
