Cardinal Hereras, who recently died in this city in his will left fifty thou sand dollars for the first Spanish general who should land in Amer ica in a war for the avenging of Spain on the United States for the loss of Cuba and the Philli pincs. In the supreme court today an order was entered refusing to probate the will and holding it it void so far as the reward for an assault on the United States was concerned, in the opinion of the court the judge stated that while the bequest might betaken as evidenue of patriotism on the part of the deceased it could not be allowed either from a political or strategetical standpoint. To even suggest another war with the United States on the part of Spain it was beyond the range of possibilities. He leaves a wife and child who re side at Winslow. Morton, the fireman was a single man. The accident occurred on the sharp curves between Crookton and Gleed. It appears that the roadbed had been softened the day before by rain, and when the engine struck it on a sharp curve the rails gave way and it left the track and went down the em bankment about one hundred feet. The escape of the trainmen asleep in the baggage cars and the rest of the train that remain ed on 4he track was certainly miraculous. The engine and cars in going over the bank took out nearly fifty yards of track, which delayed traffic several hours before it could be repaired. Flagstaff Gem.
