JOHNS H'JgKAUX which there may be any money due by assessment or otherwise for the purpose of collecting: any amounts due at public sale for cash after giving: due notice of such sale for at at least twenty days prior thereto of the date and hour thereof which shall be between the hours of ten a. m. and four p. m. by posting: three notices of such sale in public places in said Apache county, one of which shall be posted at the court house door of said county or by publishing: said notice in some newspaper pub lished in said county for said period of twenty days, said notice ! to be under the seal of said cor- poration and signed by the secre tary thereof. The proceeds of such sale shall be first applied to the costs and expenses of adver tising: and conducting: such sale; the balance to be applied to the amount due on said share or sha res and the remainder, if any, to be paid to the owner of said share or shares as the owner is showed to be bT the books of said corporation. The secretary of said corporation is authorized to transfer share or shares to the purchaser thereof at said public sale on the books of said corpora tion in the same manner as if they had been sold voluntarily by the owner or owners thereof to said purchaser. Said sale shall take place at the principle office of said corporation in St. Johns, Apache county, Arizona Terri tory. The amount of the capital stock authorized is Si Thousand ($6,000.00) Dollars, and shall be divided into Six Hundred (600) shares of the par value of Ten (10) Dollars each. Said author ized capital is fully paid up. FOURTH. The time of the commence ment of said corporation shall be the date of this instrument and it shall terminate its existence in thirty years from said date, FIFTH. The aftairs of said corporation are to be conducted by three di rectors to be elected by the stock holders on the first Saturday of the month of October in each year by a majority of stock repre sented at said meeting. The first directors of said corporation 9hall be John H. Plumb, Isaac Isaacson and E. I. Whiting: who shall hold their office until the regular election on the first Sat urday in October 1904 or until their successors are duly elected and qualified. The other officers of said corporation shall be a President, Vice-President, Secre lary and Treasurer who shall be elected by the directors from their number and their duties shall be such as are prescribed in the by-laws of said corporation. SIXTH. The highest amount of indebt edness or liability to which this corporation is at anytime to sub ject itself is Five Hundred Dol lars. SKVKNTH. All private property of stock holders is to be exempt from all corporate debts. KIGHTH. The Board of Directors of sid corporation may and are hereby authorized by an order made by them and entered on their minu tes to levy and collect assess ments on the capital stock of said company for the purpose of constructing and repairing dams, reservoirs, ditches, water gates, sluices and other things and ex penses that may be necessary for imoounding, storing, preserving, conveying and distributing water or any other labor or expenses that may be deemed necessary, and to sell any share or shares on Notice for Publication.
