It was in the case of the removal of the capital of the state of Oklahoma from Guthrie to Okla homa City, brought before the su preme tribunal on appeal. It will be recalled tbat the enabl ing act admitting Oxlaboma territory in to the union of ctetra contained tbe provision that tbe capital of tha new state should remain at Guthrie uotil a certain time and the provision was incorporated in tbe organic law of the new state. The capital was moved, bonever, to Oklahoma City. The decision of the United States supreme court is that the removal of tbe sett of etate gov ernment was constitutional, and as far as tbe supreme court is concerned the capital nil! remain at Oklahoma City. Tbe enabling act cf congress for the admission of Arizoaa to the Union as a state also contains tbe provisions giving the capital to Phoenix until 1925.
