Jno. M. Rright, spe cial Judge in this ease : Franklin County vs. Nashville, Chatta nooga & St. Louis Railroad and the Nashville, Chattanoogii A St. Lmiis Railroad vs. Fiiinkliu County. In this ense it is shown that Franklin eotiiitj-'H trustee assessed thirty-four miles of railroad in its houudur'icM for the years front 1875 to 1881, claiming they hud the right to assess the roads as the act of 1875 nnd the amendments thereto of 1X77-78 had been declared unconstitutional and void in 7 Lea Mil, the county having assessed the road ac cording to that act for those years and hail obtained the tuxes thereoti. The court held that in the first place the eonnty assessor com Id not assess for any years previous to his term of tin ofliee where taxes had failed to be as sessed, or where they had been illegally assessed. Where under the net of 187H the de cree of the assessors and examiners is made final, by the legislature, eillier party can obtain a certioraris in order to have the case tried again before cir cuit court, and by appeal from that to this court.
