Whereas, no action or proceed ing at law or otherwise has been instituted to recover the debt se cured ly said mortgage or may part thereof. Aud whereas it was stipulated ia said mortgage that if default Should be made in the payment of principal or interest aa same became due under the terms of said mortgage that the whole mortgage indebtedness should become due and said mortgage might be foreclosed by advertise ment under the laws of the State of South Dakota.
