ORDINANCE NO. .., FILED Town Clerk An ordinance by the Mayor and Common Council of the Town of Win slow, granting a franchise to the Win slow Drainage and Improvement Com pany, a ... ~ for the pur pose of constructing and operating a system of sew3rage in the Town of Winslow and for other purposes. The Mayor and Common Council of the Town of Winslow do ordain as fol lows: Sec. 1. That there is hereby granted to the Winslow Drainage and Improve meut, Company, a and its assigns, the privilege of creat ing, erecting, constructing, maintain ing and operating a system of sewerage through all streets, alleys and high ways in the Town of Winslow, and for any aud all purposes for which sewer age may be used; aud to supply, sell and dispose of sewerage rights to whomsoever may contract therefor. Aud to that end there is hereby grant ed to the Winslow Drainage and Im provement Company the privilege, at the said company’s own expense, to erect, creat, construct, operate and maintain, use aud enjoy under the streets aud alleys or other public high ways of the said Town of Winslow, pipes, conduits or other means of con veyance sewerage. dec. 2. The constructing, operating, maintaining and laying of pipes, con duits or other means of conveyance of sewerage shall be made and done so as not to interfere with business or trade upon the streets, alleys or other pub lic highways aud with due regard for the convenience and safety of the pub lic. Sec. 3. The privileges granted by this ordinance shall extend and con tinue for twenty-live years from the date of the passage hereof, provided that nothing in this ordinance shall be construed to grant any exclusive pri vilege . Sec.-4. It is provided that the Win slaw Drainage and Improvement Com pany shall make no charge for sewer age and matters appertaiug to the same in excess of the following sched ule of rates per annum: 1. Private houses, including sinks, bath aud water closets, six ($6.60) dol lars 2. Saloons, running per day only, twelve ($1200) dollars. 3. Saioous, running night aud day, having chop house in connection with saloon, eighteen ' $18.00) dollars; and saloons, running night and day, with out chop house,twelve ($12.00) dollars. 4 Restaurants, eighteen ($18.00) dollars. 5. Restaurants, with water closets, twenty ($20.00) dollars. 6. Barber shops, six ($6.00) dollars. 7. Barber shops, with baths aud water closets, twelve ($12.00) dollars. 8. Hotels, under ten rooms, includ ing water closets, twelve ($i2.00) dol lars. 9. Hotels, over ten rooms, includ ing water closets, fifteen ($15.00) dol lars. 10. Lodging houses, under ten f itoms, nine ($9.00) dollars. 11. Lodging houses,over ten rooms. [sl2 00] dollars. 12. Laundries, eighteen [slß.oo] dol lars. 13. Steam laundries, twenty [S2O.OOJ dollars. 14. Water closets, four ($4.00) dol lars. 15. Office buildings, for each closet, four ($4.00) dollars. 16. Drug stores, four [s4.oo] dollars. 20. Liverv stables, nine [s9.oo] dol lars. 21. Blacksmith shops, four ($4.00) dollars. 22. Tin shops, four [s4 00) dollars. 23. Machine shops, ten [slo,ool dol- | lars. 24. Other kinds of shops,ten [slo.oo] dollars. 25. Boarding houses, nine [s9.oo] dollars. For connecting with sewer on the premises of users, the Winslow Drain age aud Improvement Company’ shall require deposit of an amount not ex ceeding five dollars, the pipes, con duits or other means of conveyance so used to remsin the property of the said company, and in the case of im proper or illegal use, or failure to pay the sum due as provided in these arti cles, then the said company may at its option disconnect its distributing sys tem from the premises of such user or consumer, and may charge not to ex ceed three dollars for making recon nect ions. •Ssc 5. That the said Winslow Drainage and Improvement Company or its assigns, shall within fifteen days afier the passage of this ordinance, tile with the town clerk an acceptance in writing of the terms aud conditions hereof, and shall on or before she first, day of July, 1936, begin in good faith the construction of its sewer system and plant, and shall cou’imie such voi struct ion so that, by the Ist day of July, 1907, such system, works and plant, shall be in operation. Sec 6. The following rules and regulations conducive to the public health shall prevail and be recognizee and obeyed by the said Winslow Drainage and Improvement Company: 1. No privy vault, cess-pool, ex haust from engine, blow-off from boil er or house drain shall be connected with the sewer. No water closet shall be put into or upon any property, house or building, except those flushed by a tank con taining not less than four gallons of water. Every water closet, sink, slop-hop per, b ith tub, and each tray or set of wash trays or other vessel or vessels connected with the drain pipe directly or indirectly, must be separately, in pependeutly and effectively trapped aud vented. The trap must he placed as near the fixture as possible, aud in rio case fur ther thau two feet from the fixture. All sinks in kitchens of boarding houses or hotel? accommodating more than twenty persons, shall be provid ed with a suitable aud approved grease trap. No wooden wash trays or sinks shall be maintained, constructed or used in side of any building or poich. All wash trays aud sinks maintain ed, used or constructed in any build ing shall be of non-absorbent material. No union coupling of any descrip tion shall be used in or in connection with concealed work. No rubber connections shall be used except on the flush pipes only, Waste pipes in all cases shall be of lead or cast iron of the following sizes: For bath tubs, laundry trays, sinks, urinals, wash basins, each not less than one and one-half inches; slop hoppers not less than two inches. All traps and vents shall be of the same size as the wastes, provided that if more than one fixture shall be vent ed, the size of such pipes shall be as follows: For more than one and not exeediug two fixtures, one and one halt inches; for more than two and not exceeding eight, two inches; for more than eight and not exceeding twelve, two aud one-half inches; for more than twelve aud not exceeding twenty,three inches. The Winslow Drainage and Im provement Company is hereby given the right to determine what size of pipe is necessary in making connec tions. The Winslow Drainage and Im provement Company, its agents or as sign? shall have the power to stop and prevent from discharging into any public sewer owned and operated by the said company, any private sewer or drain through which substances are discharged that are liable to obstruct or clog the public sewer, or in any manner injure it. If from any cause any private sewer or drain shall become obstructed or clogged, it shall be taken up to be cleaned, aud in no case shall any sub stance so obstructing or clogging it be permitted to pass into the public sew er. Any violations of the provisions herein contained, by the said Winslow Drainage and Improvement Company shall act as a violation of the terms of this franchise,and the same shall upon proof of such violation, be revoked by the Common Council of the Town of W iuslow. See. 7. Any person or persons viola ting the provisions of the preceding section shall be deemed guilty of a misdomeanor, and upon being found guilty shall pay a fine of not more than three hundred dollars, or by imprison ment, in the Town Jail for a period not exceeding one hundred days, or by both such fine and imprisonment. Sec. 8. That the title to all pipes, machinery, appliances, buildings, structures and all other property plac ed by the Winslow Drainage and Im provement Company herein, within the corporate limits of said town, un der and by virtue of and in accordance or compliance with the terms hereof, shall be and remain in the said com pany aforesaid, aud the said company may within a reasonable time after the expiration of the term herein specified, remove the same, and is hereby given the right of euteriug upon the laud wherein or whereon the said property or any portion thereof is located, and to make alt necessary excavations therein for the purpose of removing the same; provided, that the removal of such property be done in such man ner as to cause the least possible in convenience to said town and the in habitants thereof, with all due care in respect to the same, aud that the land in which any excavattens shall be made be restore as nearly as can be to its condition before such excavation. Sec. 9. If at any time during the life of this ordinance, the Winslow Drainage and Improvement Company, its agents or assigns, is prevented by the act of God, the public enemy, an inevitable causalty or the order of any court having competent jurisdiction from constructing, operating aud maintaining its sewer system for the purposes of this ordinance, then in such case any and all obligations upon its part in according to and complying with the provisions of this ordinance shall cease, pending such interruption. Sec. 10. It shall be unlawful for any person or persons, firm, corporation or individual to damage or in any way obstruct or interfere with the pipes, conduits, buildings, structures, mach inery or appliances used by them in the exercise aud enjoyment of the pri vileges herein granted unless so au thorized by the said Winslow Drainage U£±A ¥. M and Improvement Company iforesaid. its agents or assigns, or the Common Council of the Town of Winslow: but the provisions of this section shall not apply to any person engaged in mak ing repairing grading or improving any street, avenue, alley, ground or side walk on behalf of or by the order of the Mayor or Common Council of the Town of Winslow. t-.ee. 11. Any person who shall vio late the provision of the next preced ing section shall be deemed guilty of a a misdemeanor aund upon conviction thereof shall be punished by a fine of not more than three hundred dollars or by imprisonment in the Town Jail for a period not exceeding one hund red days or by both such Hue and im prisonment. Sec. 12. If at any time during the ! life of this ordinance, from and after I the date of its passage, the said Town of Winslow shall elect to purchase the sewer system herinbefore desiguated, the said town shall notify the said Winslow Drainage aud Improvement Company or its assigns of its inten tion to do so, giving the said company or its assigns at least six month’s no tice of its intention to make such pur chase The value of the system shall be as certained as follows: The said com pany or its assigns, and the said Town shall each appoint one person and the two appointed shall choose a third,and the three persons so chosen, one of whom shall be a hydraulic engineer, shall constitute a board to determine the value of the system. In case the two persons chosen dis agree in the selection of a third, he shall be appointed by the Judge of the District Court of the Judicial District iu which Winslow is located. None of the board shall be residents of Wins low. The said board iu fixing the val uation of the system shall take into consideration the value of the fran chise and right of way,the value of the material used in the construction of the system, the revenue from the works,and all facts and considerations | legitimately connected with the said j sewer system. Iu determining the value of the ma : terial the said board shall ascertain j the amount of material in actual use, I the length of time the same has been |in use, the cash value of the material at that time, then deduct a reasonable per centage for depreciation iu the material use. In case the said Winslow Drainage and Improvement Company or its as signs shall fail or decline to appoint an appraiser, as above provided, then the District Judge of the Judicial District in which Winslow is located is hereby authorized to appoint such appraiser for the said company. Within ninet" days after the said board has rendered its decision and on the payment of the amount determin ed upon, then the said company or its assigns shall transfer to the said Town of Winslow, all of its pipes aud sewer system included in the said appraise ment. The decision of the said board shall be final aud conclusive upon each par ty. Sec. 13. This ordinance shall take effect and be in force from and after its passage. All ordinances and parts of ordinan ces in conflict herewith are hereby re pealed. • Passed by the Mayor and Common Council of the Town of Winslow the ... day of A. D., 1906.
