Thelteceiver considers this failure to cultivate the tract embraced in the addi tional entry as a defect of failure to fully comply with legal requirements, and for that reason submits the case for consid eration. The law does not peremptcrially re mlire that the lands embraced in an ad 'tional entry of this class shall be ac tually cultivated to crop. It the tract thus entered be used in connection with that embraced in the original entry for the purposes of a home. the intention of the Act of March 8. 1879, will have been secured and its purposes attained. It has been held heretofore that the tracts em braced in an original and additional en. try Will be considered as one compact body, and residence upon any portion of the same Will be considered as residence upon the whole. and I am or opinion that the .same rule should apply respecting cultivation; though in all cases of this kind improvement and use of the addi tional tract as a part of the whole home stead will be insisted upon.
