additional entry he has cleared a portion
of the lands embraced therein and fene
ed the whole tract. but that he has not
actually cultivated any part of the addi
tional homestead.
Thelteceiver considers this failure to
cultivate the tract embraced in the addi
tional entry as a defect of failure to fully
comply with legal requirements, and for
that reason submits the case for consid
eration.
The law does not peremptcrially re
mlire that the lands embraced in an ad
'tional entry of this class shall be ac
tually cultivated to crop. It the tract
thus entered be used in connection with
that embraced in the original entry for
the purposes of a home. the intention of
the Act of March 8. 1879, will have been
secured and its purposes attained. It has
been held heretofore that the tracts em
braced in an original and additional en.
try Will be considered as one compact
body, and residence upon any portion of
the same Will be considered as residence
upon the whole. and I am or opinion that
the .same rule should apply respecting
cultivation; though in all cases of this
kind improvement and use of the addi
tional tract as a part of the whole home
stead will be insisted upon.
In mg opinion, the final proof in the

the party has made substantial compli
ance with legal requirements. and the
usual tlual papers should issue to him
upon payments of the commissions due.

Speaking of Vanderbilt's probable
connection with the Pacific coast rail
road building, a New You special says
that for two years past the Union Pacil‘

gan the construction of the Oregon Short
Line, with the ultimate intention of ex--
tending the line to the coast, More re
cently arrangements have been perfected
for asccond line from Utah through No
vnda to San Francisco. The Vanderbilt
system proper consists of the most di
rectly connected roads from New York
to t ,‘hiCago, with an olfahoot to the Mise
iseippi river and to St. Louis. He has
personal management of these roads and
owns an interest in the Chicago and
Northwestern. and has recently pur
chased a controllinginterest in the Chi
icago. Minneapolis & Omaha roads.
Those under the controlling interest of
Vanderbilt may very roperly be consid
ered a portion of the glow York Central
system to be worked in unison from that
city toOmaha and points in the north
west. The recent acquisition of Hanni
bal and St. Joseph mad. with its web
‘systom. will fairly make connections
with it. The combination of these roads
with the Union Pacific is highly proba
'ble as soon as the latter roal shall com
plete its extension to the Pacific coast.
