By That Act the Owner of the Animal Lost a valuable Tract of Land. In September, 1871, Griffith Jones, a farmer of Forestport, Oneida county, purchased at a tax sale a tract of 3G0 acres of laud in the town of Alleghany, this county. The tract was wild and barren and had been abandoned by its former owner. Jones, who was a man of small means, paid 150 for the lot, and, on looking over the pioperty, made up his mind that it was not worth putting any more money in, and he paid no more attention to the purchase beyond securing his tax deed, which gave him a clear title to the land on the 2:Jd of September, 1873, two years after the time of purchase, according to the JNew York law of tax sales. In 1S70 petroleum was discov ered in Alleghany, and the former owner of the tract Jones had pur purchased reasaumed control of it, and leased it to the Bradford Oil company. Jones knew nothing about this transaction until ISS0, when the tract had tan large pro ducing wells on it and had yielded many thousands of barrels of oil which had been sold for the profit of the oil company. The terri tory was then valued at S300,000. Jones at once began proceedings in the Cattaraugus county court to recover possession of his land and an accounting for the oil on the strength of his tax deed. The oil company disputed Jones' title to the property on the clause of the tax-sale law which makes tax deeds invalid if the purchaser does not serve on the occupant of the premises bought at tax sales notice to redeem the same with two years. The oil company claim that James Hill, the former owner of the .tract, was occupying the premises when the doed passed to Jones, and received no redemption notice, and the oc cupancy was based on the novel point of law that, although the owner was not living on the tract, he had left a quantity of hay in a shanty on the place. This was the entire defense 01 the suit, and the Cattaraugus countv court de cided that if the simple fact of there being hay on the place ;i claimed could be established 11 would be ample proof of lei1 occupancy and would destroy Jones' title to the property. The trial resulted in iavor of the oil company in 18S2. A new trial was granted, and Jones proved by six witnesses that on the 23d of September, one day before he became entitled to the tax deed, Hill's cow had entered the shanty and eaten all the hay that Hill had left there, thus de priving him of legal domicile and leaving no one in occupancy on whom redemption notice could be served. By that act of Hill's cow, and by that alone, Jones' title to the valuable property was estab lished, and he was given a verdict. The defendants obtained an order for a third trial on the alleged dis covery of new evidence, but Jones was again successful. The oil com pany carried the case to the gen eral term, where the judgment was affirmed. The case was then taken to the court of appeals, where an effort was made to have the judg ment reversed on the ground that tho tax-sale law was unconstitu tional. The court of appeals has just handed down an opinion sus taining the decision of the lower courts, and Jones will receive nearly $500,000 for the oil that the property yielded during its posses sion by the Bradford Oil Company. An Amusing Experience of His Lur ing an Ohio Campaign. Senator Hale who has spoken in political campaigns in most of the states ol the Union, and is always eagerly sought for by the party managers, was asked the other day what state he liked'to speak in best. He said that in the west as a rule stump-speaking was pleasantest, the people turned out so freely and were so quick, appreciative and generous with their applause. Upon the whole, he thought it was pleasanter to stump in Ohio than in any other state. "I had an amusing experience there one," said the senator. "It was in the fall of 1875, when Hayes was running against Will iam Allen. I was stumping Ohio in company with the late congress man Updegraff. "We were billed for evening speeches in a little town called Rushsylvania, in Union county, I think. A stand had been erected on one side of the main street racing the open road way, in which had been placed benches made by laying planks on blocks of wood and stones. Be hind the stand and all along tho sidewalk a large crowd of people had gathered. 'When the hour came for opening the meeting no one occupied the seats except a big colored man, who sat with his elbows on his knees and his knees and his chin iu his hands. Judge Coates, a prominent old gentlemen, appealed to the crowd to pass around and occupy the aeats. But they were bashful, and no body would lead. "I was to speak first and judge Coats urged me to turn and speak to the crowd where it stood. I declined to do so. I said: 'Here are the seats for the audience, and here the audience ought to be.' Judge Coates introduced me, nearly facing the throng at tho rear, who gave me a round of ap plause. 1 stepped to the front of the platform, and looking straight at the colored man said: ' 'My fellow citizen.' "At this there was a great laugh, and the people came streaming around both sides of the platform to the front, and we had one of the best meetings ever held in the town. "There was a correspondent of aCincinnatti paper to accompany us. Next day there appeared in his paper a long dispatch begin ning: 'The campaign is getting warm in Union county. To-night Hon. Eugene Hale of Maine ad dressed the largest and most en thusiastic darky ever assembled in Rushsylvannia.' ,'Thhat is how the story was started that in one of my meetings 111 Ohio I had only one man, n col- oredman, to listen to me.'
