and the fust compensation to be made therefor:
And Whereas. 1'hls Court did on the 8th day of
August, A. D. l'.xU, upon a due examination of
such application and of all the proceedings there
tofore taken in tne premises, nun ana declare
tho same to be in accordance with the statute In
such case made and provided, and did thereupon
by on order entered therein, appoint
Friday, the 26th day of August, A. D. 1904
at uino o'clock In tlte forenoon of that day, as
the time, and the ofllee of the Judge af Probata
in tho City of l'ort Huron in said County as tho
place when and where a hearing upon such a
pllcatlon would be had. and did then
and there order that all persons whose
lauds were travered by such Drain, and who had
not released right of way and all damages on ac
count thereof, to appear at the time and place so
designated and to be heard witli respect to such
Application, if they so desire, and to show cause.

Is hereby made to the profile of tlte grade cut of
the same which Is made a part of this survey and
return with these paiers. The following table
shows the stations of said Drain, width of bot
tom, depth of cut below top of grade, peg width
of top at grade Peg, width of ground for dispo
sition of excavated earth, slope of each side at
each station of said Drain, also the whole width
of land taken for the construction of the same,
as follows:

been neglected or refused by them, Is traversed
by said Drain.
Now, Therefobb, All such non-resident
persons, owners of the above described lands
and each of them, are hereby cited to be and ap-

Thos. Dawson, father of Wm. Daw
son of Sanilac Centre, died at his home
in Memphis Thursday evening, July
28, asred 84 years. Mr. Dawson was
one of the best known and for many
years one of the most influential men
in Macomb county. He was supervisor
of Grant township, St. Clair county,
for eight years and served on the Ma
comb county board of supervisors for
twenty-three years, and it is claimed
he made out more assessment rolls
than any other man in the state.

ORDINANCE NUMBER 31.
An ordinance relative to throwing or batting
any Hall, stone or other Missile upon tho J'ubliu
Streets within th Village of Vale,
The Village, of Vain ordains: That it shall here
after be, and Is hereby niado unlawful for any
person or rersons to throw or bat (strike with a
club) any nail, stone or other missile upon any
public street In tho Village of Yale, or bat or
throw any ball, stone or other nils , lie in sueli a
manner as to cause tne same io lau upouorpu&s
across any public street within said village.
Any person who shall violate the foreirolng
provision of this ordini'we shall, upon convic
tion thereof, before any court of competent Jur
isdiction, pay a lino not to exceed live dollars
and eosts ot prosecution, and in default of the
payment of such line and costs of prosecu
tion shall bo imprisoned in the county jail
of St. ( lair countv, the county in w hich said
villas Is located, for the term of fifteen
davs or In tho discretion of tho court In the
village Lock-up of said village of Yale for th
term of fifteen days, unless payment of said liuo
and costs be sooner paid.
This ordinance shall tako effect twenty days
after Its passage. . .
