Onn hundred and seventy-five shares are al ready paid up in the new series. Dr. S. M. Jenks got out of bed an hour last evening for the tirst time since he was taken ill two weeks ago. He has be*n suffering very severely from sciatica in the right limb and side. This disease in the big Derve causes a pain similar to rheumatism though in this case more aonte and well defined locally. The doctor's health has not suffered, but he has been com pletely prostrated so far as locomotion is concerned. He expects to be around again by the middle of next week. THE WRONG WAY Chancellor Reed of New Jersey Dismisses the Tobacco Trust Suit. Charter, If Anything, Is Wrong, and Should Be Attacked in Law Courts. Proceedings Inaugurated to Test Pingree's Right to Hold Two Offices. TRENTON, N. J., March 13.—Vice Chancellor Reed has filed with the clerk of the court of chancery his deci sion dismissing the bilHjrought against the American Tobacco company. The suit was brought jointly in the name of the attorney general and Miller Bros., tobacco dealers of Newark, for the purpose of restraining the tobacco trust from transacting its business, and from conducting the business iu a man ner prejudicial to the complainants, and injurious to the people of the State of New Jersey. The opinion is a vol uminous one and Vice Chancellor Reed makes comparison as to what would be the rights of an individual and of a cor poration unJer the same condition. He says that it would not be thought of to go into court to restj|iin an individual from exercising the right of selling to whom he pleases and he argues that a corporation has the sansie right in this respect as an individual. He says it is perfectly obvious in this case, on the assumption that the American Tobacco company is a legally organized corpor ation, there is not the slightest ground for imputing to it conduct since its or^ gnnization of an ultra vires character. The question as to whether the corpor ation is legally organized is one, the chancellor holds, which should be de termined by a court at law, under quo warranto proceedings. THE DETROIT MAYORALTY. Proceedings to Km Inanguratod to Doeldo PlD|r««'i Right. LANSING, Mich., March 13.—The su preme court has affirmed the decision of the Wayne (Detroit) circuit court in holding that D. T. H. Moreland, as a private citizen, had no right to com mence the proceedings heard there to oust Governor Pingree from the office of mayor of Detroit. The court announced that an order would be entered requiring the attorney general to file a petition against the common council. An order was also made directing the council to show pause next Tuesday why a mandamus should not issue to compel it to order a special election for mayor. Pallmin Company Liable. GALVESTON, Tex March 18.—The court of civil appeals has affirmed the decision of the lower court in the case of the Pullman Palace Car company, versus Thomas W. DES MOINES, March 13.—The railroad commissioners have served notico on the Great Western, Des Moines Union Wabash and Des Moines, Northern and Western railroad companies, and F. M. Hubbell to provide a new pas senger depot in the place of the present union depot by May 1. The Union depot is condemned as unfit and unsafe. To Prevent Gold Clause*. OMAHA, Neb., March 13.—A special to The Bee from Lincoln, Neb., says the house passed without the emer gency clause Wooster's bill prescribing what shall be a legal tender in Ne braska. This bill is intended to pre vent the insertion of the gold clause in contracts, notes or mortgages. E. E. Moat Volaminon* Indictment on Record. LOUISVILLE, Narch 13.—The most voluminous indictment ever returned in a United States district court in Kentucky was entered at noon ,by the federal grand jury against J. M.
