Fox and wife of Doon, Iowa, who have been guests in the family of Henry Hundemer, departed by the south train on their return home. Mgr. Flynn departed this morning for Milwaukee in response to a tele gram announcing the death of Father Kinsella, a distant relative. A. W. McCready who has been in the city the past two or three weeks looking after his property interests, departed this morning on his return home to Los Angeles, Cal. 2 Jacob Linzmeier and family depart ed this evening for Alberta wtiere they will visit a son and a daughter and then proceed to Tulaire county, Cal where they expect to reside. Mr. Linzmeier recently sold his half sec tion farm in Franklin township for per acre. H. M. Penn returned last evening from Chamberlain, having taken Misses Jackley, Shearer. Noble and Lewis, teacbeis in the high scnool, by auto mobile, for registerng for Tripp county lands. The trip of 225 miles was made in short time, the party leaving Mad ison at 5 o'clock Saturday evening and reaching home at 4 o'clock last even ing. Senator Gamble has appointed Julius R. Doerine. o Tripp, as principal to take entrance examination to West Point as cadet and Albert J. Harno of Highmore was appointed alternate. The examination will be held at Fort Logan, Col., on the second Tuesday in January. The appointment of the sec ond alternate has not yet been an nounced, but will be given oat later. Mr. Charles Glen Thomas and Miss Manza Stegner were manied at the lesidenceof J. W. Davison yesterday morning, Rev. D. J. Mitterling of the Presbyterian church officiating. The young couple are connected with the Berlin moving picture theatre and have been residents of Madison only a few weeks, coming to this city from Mason City, Iowa. Mr. and Mrs. Thomas went to Sioux Falls by the early train yesterday morning. Senator Borah ot Idaho is billed for four speeches in Sonth Dakota this week. He will appear at Parker in the afternoon of October 14, at Huron tne evening of the same day, at How ard the afternoon of the 15 th and at Madison in the evening of that day. Senator Borah is recogni/.ed as an oia •or of note throughout the country. Hyslop of Aberdeen bene diction by the bishop. EGAN CASE Supreme Court Decision—Egan Still Eligible for State's Attorney The decision of the supreme court in the proceedings to disbar Geo. W. Egan of Sioux Falls, recites the methods of Egan in securing the transfer to him self of property to the value of |10,000 from Mrs. O'Grady, alleged insane, Mrs. O'Giady was charged with tht murder of her husband, and Egan as her attorney, it is alleged, used unpro fessional methods in obtaining the transfer of her property to himself. The supreme court in its ruling says it is found "that theie are no extenuating ciicumstances attending the transac tion and conclude by ordering the name of George W. Egnn stricken from the roll of the court, the license here tofore issued him canceled and that the accusers recover judgment against him for tueir disbursements in the proceed ings, to be taxed by the clerk of the supreme court." Egau is the republican nominee for states attorney in Minnehaha county, but the decision of the supreme court does not prevent Mr. Egan's name from appearnig on the ticket as a candidate for states attorney, nor prevent him from holding the office. The supreme court of this state in the case of How ard vs Burns has decided that to nold the office of states attorney a person is (t v not required to be admitted to tbe bar in this state. "The legislature shall have power to urovide fur states attorneys and to pre scribe their duties and fix their com pensation. but no person shall be eligi ble to the office of attorney general or states attorney who shall not at the time of his election lie at least 25 years of age and possessed of the other quali fications for judges of circuit courts as prescribed iu this article.' "This practically leaves the only question to be determined as to whether Mr. Eg.'.n is learned in the law. The supreme court composed of the same judges who now find against him, de de thut Mr. Egan is 'learned in the law' by admitting him to piactice. The supreme court of Iowa has also held that he is 'learned in the law' and according to the decision of Howard vs Burns it would not have been necessary even for the courts of this state to find him 'learned in the law' if he had been found so by the su preme court of any other state." Mr. Egan has announced a speech a the New Theatre in Sioux Falls Thars dayevening, "My tight for Liberty," or "The Kaufman Case and What lt Did for Me,'' when he will give his story of the whole affair.
